Smith started to backpedal,
saying that maybe the front
wheels weren't in the store,
but up to where the truck
jumped the curb. Or, she said,
maybe the wheels were about
15 centimetres inside the
door. Smith said the truck was
"all over the place" and
"erratic" when it was backed
out, then driven away. A man
in a blue car spoke to her in
the parking lot, she said, then
followed the truck and came
back moments later to say two
men had been arrested.
After a short break, Christa-
kos came back to say the
Crown's office never treated
O'Reilly's case differently
because of his celebrity status
and that he was "proud of
Mrs. Smith for testifying."
But "there was no reason-
able prospect of conviction
to put Mr. O'Reilly behind
the wheel of the vehicle that
morning."
McKay said it was clear to
him that Smith was trying
to be truthful and honest,
but agreed with the
Crown's assessment. A pro-
vincial offences charge was
dropped as well.
"You're free to go," McKay
said.
Outside the courthouse,
O'Reilly thanked his friends
and family, while Humphrey
boiled down why the
Crown's case evaporated.
"This is a simple case. Mr.
O'Reilly has always said that
he was innocent. He's dis-
puted that he was the driver,
he said.
Smith's evidence in the
face of "the objective, unde-
niable evidence" of the pho-
tos was "a fundamental mis-
recollection by the one
witness who was purported
to be able to identify Mr.
O'Reilly as the driver;' Hum-
phrey said.
"It simply follows that if
she could be so glaringly
wrong about such a basic
fact, she could be wrong in
making the identification,
and we say she is:'
Smith said as she was
leaving the courthouse that
she stood by her testimony
and insisted O'Reilly was
driving the truck when it left
and that there was no "mys-
tery driver.
"The only thing I can say is
I know he was driving, he
knows he was driving. Drunk
driving isn't OK for anybody,
no matter who you are
