McCarthy does not want these cu'n-
plaints removed, and for three specific
reasons. Strangely enough, these
three reasons are categorically answer-
ed by the Judicial Committee of the
Privy Council. The first is that the
right to Separate schools was not guar-
anteed because the genuine "bill of
rights" presented at Ottawa by the de-
legates from Manitoba in 1870 contain-
ed no reference to Separate schools,
and no demand that they should be
given. This point was taken before the
Judicial Committee, and the reply to
it is as follows: -

While Air. Dalton McCarthy was
telling the electors•of Haldinland that
" in order to knock ou4 Mr. Laurier
"in Quebec, the Government had set
"up a question to deliberately arouse
" the passions of the French habitants
"and have for themselves the solid
"French vote," Mr. Tarte was saying
in Vercheres that the Conservative
party in Ontario "is under the abso-
lute sway of the Orangemen, whose
"chief object was the destruction of
"Separate schools." It is rather for-
tunate for the opponents of the Gov-
ernment that the speeches of Messrs.
McCarthy and Tarte were delivered
with it proper regard for geographical
goal racial considerations.Lad Mr.
McCarthy gone to Vercheres and Mr.
Tarte to Haldimand the cause o, her
Majesty's loyal Opposition would have
neer seriously impaired. The con-
flicting stories told in the two
c( stittleneiei are of themselves
suggestive enough ; but Mr. Mc-
('arthy's statement, with which we in
Ontario have more particularly to do,
is especially so in that it emphasizes
the degree of accuracy with which that
gentleman approaches the question.
We are told that the Government has
"set up a question" to deliberately
arouse the passions of the French
habitants. Those who have followed
the history of the Manitoha case must
know that the question has not been
"set up" by the Government to arouse
passions of either one kind or the
other. The question has !leen forced
upon the -Ministers by the constitution.
Having the case laid before them with
the full warrant of the Judicial Com-
mittee and upon the advice of Mr. Mc-
Carthy, who himself directed the com-
plainants to Ottawa, the Ministers, as
a matter of ordinary duty, had to deal
with it.

"The terms upon which Manitoba
" was to become a province of the
" Dominion were matters of negotia-
" tion between representatives of the
" inhabitants of Manitoba and the
"Dominion Government. The kerma
" agreed upon, so for as education was
"concerned, 'must' be taken to be em-
" bodied in the 22nd section of the Act
" of 1870."
Obviously, the question is not, what
the delegates asked, but what the con-
stitution granted. Now, Mr. Mc-
('arthy denies that under the constitu-
tion the Dominion Goyernnlent can
properly hear and decide a complaint'
from the minority, or that Parliament
can legislate. His words are :
"It had been admitted since Confed-
"eratiou and since the settlement of
"the Now Brunswick school question
" that, although the Dominion had
"oversight of provincial legislation, it
"hard no right to interfere in the mat-
" ter of education."
Here the New Brunswick case is
strangely mixed up with the Manitoba
case, and the action with reference to
the one is made a precedent for action
with reference to the other. But every-
body knows now that the cases are not.
similar. The Dominion Piu'liatment
had no jurisdiction in the case of New
Brunswick because the New Brunswick
School Act did not abolish a single
Separate school. In Manitoba, the
situation was entirely. different. Sep-
arate schools had been granted, and
Separate schools had been abolished.
The Privy Council, however, settles
the plain point as to the right of the
Dominion to interfere in clatters of
education :
"Bearing in mind the circumstances
" which existed in 1870, it does not
"seem to their Lordships an extr•ava,
ant notion that in creating a Legis-
" lature for the province with limited
"powers it should have been thought
" expedient, in case either Catholics
" or Protestants became preponderant,
" and rights which had come into ex-
istence under different circumstances
" were interfered with, to give the
" Dominion Parliamant power to leg-
islate upon matters of education so
" far as was necessary to protect the
" Protestant (>1' Catholic minority, as
"the case might he."
The third issue raised by Mr. Mc-
Carthy, and replied to by the Judicial
Committee, is a follows :
"It was folly to say that Catholics
"could not attend Public schools."
The highest court says:
"Moreover, while the Catholic in-
habitants remain liable to local as-
" sessment for school purposes the pr( -
" coeds of that assessment are no
" longer destined to any extent
" for the support of Catholic schools,
"hut afford the means of maintaining
schools which they regard as no more
"suitable for the edlu'+ttion of Catholic
"children than if they were distinctly
" Protestant in their character."
From first to last Mt'. McCarthy is
as much in conflict with the Judicial
Committee ars with the Government,
and for the vt'ry good reason that the
Administration has simply followed
the decision of the highest court. The
case which Mr. McCarthy is present-
ing is really a case against the Judi-
cial Committee. But it is equally at
case against the Protestants of Can-
ada. Mr. McCarthy is, unconsciously
perhaps, seeking to destroy or to nul-
lify the constitutional safeguards
which the Protestants of Quebec have
in respect of many of their educational
rights. Deny the minority appeal to
Ottawa and the Knarantee for which
the Quebec minority fought is for ever
lost.
While Mr. McCarthy is in error
touching the conditions under which
the question has arisen, he is equally
so in 111s discussion of the details. Take
for example his statement 1 hat in
Manitoba "both political parties were
"agreed as to the propriety of ehang-
"ing the educational system of the
" province." The idea that is here con-
veyed is 1 hitt both Conservatives and
Liberals alike, in fact the province

the Separate schools. This is incor-
rect. The ('onservat.iyes desired that
the constitutional poi ntshonld be tried
before the schools were touched, in
order to avoid the dispute which has
since arisen. Their position was
similar to that of Sir Oliver Mowat
with ref'er'ence to prohibition. The
thing should not be done until the
right to do 1t ilad here eslablistled.

court has been received a body of Con-
servative opinion in Manitoba is in
fatvdur, not perhaps of a r'e'turn to tile.
old conditions, which in ninny respects
were undesirable, but to such lin d111 -
cations of the law as shall remove in-
justice wherever found. The Con-
servatives' desire is precisely that of
the North-West Baptist --as good n
Protestant journal as Mr. McCarthy is
a Protestant gentleman - -that the Pro-
vincial Legislature, having the views
of the Judicial Committee before it,
should take action. it will ht' found
on an examination of the decision of
the Cabinet that that deliverance also
suggests that the Provincial Legisla-
ture take over the case. it is there
pointed out that, while the Dominion
Parliament has power to intervene, the
Legislature is "the proper and prim-
"ary source of legislation," and, as
the proper and primary source, ought,
to take the matter out of the Dominion
jurisdiction. This underlying principle
of the Ottawa derision answers Mr.
McCar'11hy's question:
"What right had they to force upon
" the people of Manitoba schools to
" which they object?"
On the contrary, the Government
has not forced upon the people
schools M any description whatever.
When, however, Mr. McCarthy sug-
gests the impropriety of forcing
upon people "schools to which they
"object," he is treading upon danger-
ous ground. Assuming that the golden
rule applies, his argument points di-
rectly to the desirability of an
akWornen
