Whitney de sworn, know de fondant; saw her On Monday morning a •the fire about 2 o'clock; at that time he premises were on fire; when I first sa her she was standing on the side -walk a the' door of her building; she was makin no attempt whatever to alarm the neigh -bora; I accosted her and said, this is your place on and she then said, n't My God, is there no one to help me looked into the door of defendant's store, and saw' a pile of clothes within the door which looked like a bed and bed- ding; the fire was not up to the bed when r saw it; I did not notice that she had any articles carried out; the fire seemed to be in the backpartiof defendant's build- ing when I first se* it; I am • positive she was not giving any alarm of fire, and did. not do so until I approached her; was positive in my own mind that defend ant had set fire to the premises, and sai to her -when she spoke to me that it wa a pity she was not in the fire; the com mon report has been that the defendan kept a house of ill -repute; r had no per senal knowledge regarding the characte 'of the house except -thet myself, an other members of our I family hav seen parties going and coming from th otiose at unseasonable hours.
