THE PLANNING ACT 1990 NOTICE OF THE PASSING OF A ZONING BY-LAW AMENDMENT BY THE CORPORATION OF THE MUNICIPALITY OF SOUTH HURON TAKE NOTICE that Council of the Municipality of South Huron passed by-law #9- 2008 on the 7th day of April, 2008 under Section 34 of the Planning Act, R.S.O. 1990, as amended. AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the by-law by filing with the Clerk of the Municipality of South Huron, not later than the 7th day of May 2008, a notice of appeal setting out the objection to the by-law and the reasons in support of the objection, accompanied by payment of the fee prescribed under the Ontario Municipal Board Act. AMOUNT OF FEE for an appeal is $125.00 payable by Certified Cheque or Money Order in Canadian Funds, made out to the Minister of Finance and accompanied by OMB Appellant Form (A1) which is available on their web site at www.omb.gov.on.ca Only individuals, corporations, and public bodies may appeal a zoning by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincor- porated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. AN EXPLANATION of the purpose and effect of the by-law, describing the lands to which the by-law applies, is described below. The complete by-law is avail- able for inspection at the Clerk's office during regular office hours. Dated at the Municipality of South Huron This 10th day of April, 2008. Sandra Strang, Clerk Municipality of South Huron 322 Main St. S, P.O. Box 759, Exeter, ON, NOM 1S6 PURPOSE AND EFFECT This zoning by-law amendment amends By-law #12-1984 Stephen Township Zoning By-law, and By-law #13-1984 Usborne Township Zoning By-law, both being by-laws of the Municipality of South Huron. The purpose of the proposed zoning by-law amendment is to implement how the Minimum Distance Separation formulae is applied to the creation of surplus dwelling severances and building on existing lots (lots of record) designated agriculture in the South Huron Official Plan. This zoning by-law amendment deletes the current provision that establishes properties zoned AG4 (agricultural small holding) as a "Type B" land use and establishes that a property zoned AG4 shall be treated as a "Type A" land use for the purpose of applying MDS I. The effect of this zoning by-law amendment is that no residential building or structure will be permitted to be severed or constructed on a property zoned AG4 unless it complies with the minimum distance separation formulae — Type A land use. This zoning by-law amendment was initiated by the Municipality of South Huron. A related Official Plan Amendment (OPA #6) has been approved by Council of the County of Huron is now undergoing an appeal period. This zoning by-law amendment applies to all land zoned AG4 (agriculture small holding) and designated Agriculture in the Municipality of South Huron Official Plan.
