PURPOSE AND EFFECT
BY-LAW NO. 103-2004
TOWNSHIP OF LUCAN BIDDULPH
General Amendment to By-law 100-2003
The primary purpose of this general amendment to the Township's comprehensive
Zoning By-law is to incorporate standards with respect to the location, height and
characteristics of wind generation systems, commonly referred to as wind towers.
In all zones, the number of wind towers is restricted to one per lot and subject to the
requirements governing accessory buildings and structures. In built-up residential
areas, additional or superceding restrictions on location (i.e. rear yard and interior
side yard), maximum height (20 m or 66 ft) and maximum generating capacity (5
kilowatts) are established. The Interim Control By-law adopted by Council on April
1, 2004 to prohibit wind towers from being erected in the Township until their
potential impacts are evaluated and appropriate regulations brought into effect, is
repealed with the coming into effect of this By-law.
The By-law also addresses matters of a general or `housekeeping' nature. Since
adoption of the Zoning By-law on 7 October 2003, a few matters have been
identified in the course of the day-to-day administration of the By-law which
requires attention. These range from matters of interpretation and administration,
definitions, general provisions, regulations for accessory buildings and structures in
the General Agricultural (Al) Zone and Special Agricultural (A2) Zone and mapping
errors. The changes correct errors identified in the adopted version of the Zoning
By-law and clarify the intent of the By-law.
An Official Plan is in effect in the Township of Lucan Biddulph. The County of
Middlesex Official Plan is also in effect in the Township. The By-law is considered to
be in conformity with both plans.
