Mr;;. (Dr.) H. H. Cowen and fam-
ily of Exeter were Saturday visitors
in town.
Monday, was observed as All .Saints
Day in the R. C. Church at which
special services were• held through-
out the church.
Mr. and Mrs. T. L. Williams, Miss
Ethel and Calvin Williams were re-
cent visitors to Port Huron and en-
joyed a drive over the new bridge.
Mr. and Mrs. Orville Witmer have
moved their effects in their new home
on Victoria street recently purchased
from Mrs. Garfield Brown.
Mr. Elmer Filsinger of Kitchener,
and Miss Marjorie Wilhelm of Mil-
verton were Sunday visitors at the
home of Mr. and Mrs, C. L, Smith.
A goodly number motored eo Cred-
iton motored to Crediton last Thurs-
day evening where they attended the
services in the Evangelical church at
which Bishopp G. E. Epp was the
speaker.
Mr. and Mrs. Abeam Eckel who
have been visiting with their son in
Zurich for a few weeks returned to

While here Mr. Eckel treated himself

Mr. and Mrs. Chris. Swartzentruber
of the Brnoson line were recent at
Lowvill_e. N. Y. State. While n Irs.
Swartzentruber remained fon a time
their daughter Mabel. who had been
at Lc e ville for some weeks, return-
ed to her home. They made ase of
the new Thousand Island l ridge near
Kingston in- crossing the St. Law-
rence.
83rd BIRTHDAY
Mrs. Wm. Bassow of the Bronson
line celebrated her 83rd birthday on
Sunday, she was the recipient of
many congratulations, cards and
gifts. The family, relatives, and fri-
ends gathered in number Cif 55. A
large candy mounting was centering
the dinner table with 83 candles on
it. After dinner the presents were
opened and cards read by Mr. Roy
IP'ask, of Clawson, Mich., after which
there was singing and music. Mrs.
Bassow thanked them all sae -tile gifts
that were given. Relatives and fri-
ends were present from Detroit. Claw
son, Mich; London, Greenaway, Shipka
Dashwood, Exeter and Zurich.
Some Brief Notes On The
Canada Temperance Act
No. 7—Judge Currey Dec..ares the
Canada Temperance Act in Force.
Manitoulin ie under the Canada
Temperance Act., but unlike Huron,
Perth and Peel it did not ask suspen-
sion and the Dominion law has eon-
tinued to operate continuously for
the liquor charges it covers despite
the coming of the Ontario Temper-
ance Act and the subsequent Liquor
Control Act.
In the case of Manitoulin, it not
having been suspended, there was no
question of the Canada Temperance
Act not being "in force." Accord-
ingly the Ontario government from
the beginning refrained from placing
authorities in that area, and although
hotels sell Iight beer (4 4) there is
no legalized hevera;e room in Mani-
toulin unto this day.
During the spring of 1938 a case
w: ose in Manitoulin Island which is
of considerable importance and which
exactly counters the decision ox the
late Judge Grout of Peel. A Mrs Sol-
somon was accused before a magis-
tral^ c ' s..• 'ug liquor. The charge
was laid under the Liquor Control
Act. The magistrate convicted; her of
violating that law. Appeal however
was taken before the county judge
for that area, Judge Currey, who
quashed the conviction holding that
the Canada Temperance Act Ts in
force in Manitoulin and that the
charge of selling should have been

- The -government of Ontario ap-
pealed from the decision of Judge
Currey to the Supreme Court of On•
tario. The case came up in the early
summer ,before a full bench with the
late Mr. Justice Latchford, acting
Chief Justice, presiding. The hearing
was from several points of view a
very interesting one. The Ontario
government was .represented by Mr.
Snyder and Mr. Magone. When the
case was called the Acting Chief Jus
tice stated that it seemed unnecessary
to hear arguments; the matter had
been before the Privy Council and
the court was familiar with the legal
ground and was prepared to d smiss
the appeal. 'Mr. Snyder pleaded
that the court should hear the argu-
ment of Mr. Magone. Willing to con-
cede in measure, the court then in-
-quired as to the counsel for the de-
fence . It developed that he was
absent. Further inquiry ea.• red the
fact that he had been notified of the
hearing—which was on Monday --only
on the previous Friday and had re-
plied by wire on Saturday that he
was engaged in the local Assize ,Court
and could not attend. The court
then demanded to know why, since
the date for the hearing was settled
by consultation between the cour`
and the Attorney -General's Depart-
ment some ten days or more previ-
ously, and since it was the duty of
the Attorney -General's Deportment
to notify the defence counsel accord-
ingly, why he had been given on-
ly two days notice. Not saVefact-
ory answer seemed to be fox-thcom-
frig and the court obviously disappro-
ved of what had happened.
During the interchange it was sug-
gested by Mr. Magone that the court_
might fallow the decision of the
Supreme Court of Near Brunswick.
This court held in 1935 that the Ca.n-

the Dominion Parliament. This jud-
gment was prepare i and delivered by
the Hon. Mr. Justice Baxter. It will.

In reply to Mr. Magone's suggest-
ion the court witha pile replied
that it preferred to follow the decis-
ions of the Privy Councie the plea

ing still pressed, the case was defer-
red until the September sating on
the ground that the defence counsel
had not been properly notified.
Whether the govexninent wills pro-
ceed with the appeal arising out of
