APPEAL DISMISSED

Owen Geiger of iiensall were glad
to see by the Toronto Papers on
Friday that he had again won a,
a ' ictory, this time in The Court
of Appeal at Toronto, in theac-
tiun of the Excelsior Co. of Cle-
veland against himself. The ease
was fire tried at Exeter by, His
Honor Judge Lewis who- gave jud-
gment in favor of Mr. Geiger but
was appealed by the Plaintiersani
was reviewed by the full Court of
five Judges early last month,their
decision being reserved until now.
The, action arose over the duty on
a cargo e.d of flax 'shipped to Cle-
veland; Mr. Geiger had contrac-
ted to pay the duty. are] did so
to the 0.N.R, at Fle asall whenship
trent was made. The Railway Ca.
did not forward th,e duty prompt-
ly however and the car arrived at
Cleveland not cleared. The* eon-
'signees did not notify Mr. Geiger
of this but. attempted : ',)
ear cleared themselves,
however the American, tariff on
flax towe was increased. bty a
large amount and they were 'corn -
compelled to pay upwards of
$200.00 raore duty to release the
'shipment, For this excess they
•sued Mr, Geiger but he contested
his liability on the ground that it

in, neither notifying hint nor
paving the duty promptly before
the rate went up that wait-. the
cause •of this loss, Both !Courts
have n,ow given judgment in fav-

!being the perfect part of a circle does not injure the wire
in any way and allows the air to circulate through and dry
any moisture on th,e wires thereby removing, the first ca.u'se of
rust. The knot in a fence is put to the severest tests bye
railway and highway officials. The Peerless knot has with-
