Local Option at Bensall.—An in-
teresting state of affairs has arisen
in the village of Hensall, this coun-
ty, as the result of the passing of a
local option. bylaw. The measure
has been attacked on the grounds
of having been irregularly passed,
and now. the council has passed a
resolution withdrawing their de-
fence of it. A ratepayer, Samuel
Si Tillie, took the matter up, and
last 'Wednesday moved, at Osgood°
Hall, to quash the council's resolu-
tion, He was unsuccesful in this,
but gained his real point, the pri•
vilege to defend the bylaw in case
the council does not. This was
gr:crated by Judge Teetzel. The by-
law was passed May . 27 last, by
more than the required three-fifths
vote. James Coxworth, a hotel
proprietor, began an action to
quash it. The council started to
defend it, but by a resolution pas.
sed October 7, withdrew their de-
fence, because of a. petition to that
effect, Samuel Smillie, a ratepayer,
applied to quash the motion, or in
this alternative, to defend it hin-
