The Kress Bros., who escaped from
Constable Scott some weeks ago, were
arrested this week at or near Millbank
for burglary. Some stolen goods were
bound on them. They will likely be

IN Tag Tome.—Harry Garbutt, who,'it
will be remembered, was arrested some
weeks ago on en extradition warrant
charging him with forgery in the Uuited
States, came up again on Saturday, at
Toronto, before Judge Morgan. A dif-
ference arose between J. W. Curry and
the cop my Crown attorney as to who
should .00nduot the .prosecution, Mr.
Curry claiming that be was specially re.
tained by the City Bank of Sherman,
Texas, whio is the bank upon which
the alleged forgery was committed, the
comity Crown attorney •claiming his
right as rimier counsel to go on with the

ed and kir. Badgerow examined the first
witness, from VanAlotyne, Texas. The
witness, J. P. House, hotelkeeper, testi-
fied that he knew Garbutt, in Texas as
James Huntley, and in March last Went
with him to the . VanAletyne Bank,
which is a branch of the Bank of Sher-
man, Texas, where he saw Garbutt de-
posit a draft on the Chase National Bank,
purporting to be made by Hord, Burson
& Co. and endorsed by Huntley, for 31,
500. Mr. Murdooh, counsel for the
prisoner, oroes•examined House, asking
him if he would be surprised to hear that
Garbutt was to Wingham, Ont., on the
9rd, 4th and 5th of March, to which the
witness replied that he undoubtedly
would be astonished, but that he could
not be persuaded that such was the one
however many witnesses swore to it.
