. TOWNSHIP OF HOWICK
ANIMAL CONTROL BY-LAW
The Howick Township Council, at its meeting on May 7th, 1979, pro-
visionally adopted By -Law No. 11/79, a By -Law concerning Animal
Control. The By -low is reproduced below for the information of Howick
Township residents. Council will be giving consideration to the third
and final reading of this By -Law at its next regular meeting in June.
A By -Law pursuant to the Dog Tax, Livestock and Poultry Protection
Act, Chapter 133, R.S.O. 1970, to regulate and control the running at _
large of dogs in the Township of Howick.
WHEREAS Section 7 (1) of the Dog Tax, Livestock and Poultry Protection
Act (hereinafter called "the Act") provides that By -Laws may be passed
by the Council of a Township having a population of less than 100,000
for prohibiting or regulating the running at large of dogs in the Muni-
cipality and for seizing and impounding and for killing dogs found
running at large in contravention of the By -.Law,
AND WHEREAS Section 7 (2) of the Act provides that dogs shall be
deemed to be running at large when found in a highway or other public
place and not under the control of any person,
AND WHEREAS Section 8 of the Act provides that a By -Law may be
passed imposing fines of not more than $50.00 upon every person
who is responsible for a contravention of the By -Law,
THEREFORE BE IT ENACTED by the Council of the Corporation of the
Township of Howick and it is hereby enacted by the authority of same;
1) THAT no person owning, possessing or harbouring a dog or dogs
shall allow or permit said dog or dogs to run at large within the
municipality of the Township of Howick at any time, and for the
purposes of this By -Low the term "owner" shall include a person
having care, custody or control of a dog or dogs.
2) THAT any dog found running at large in the said Municipality will
be seized and;
a) if by means of a tag duly issued and bearing the serial number of
the Municipality attached or otherwise affixed to the dog, the said
dog can be properly identified and the owner of the dog asertained
the dog will be returned to the owner and released to him upon
payment of the appropriate fine imposed hereunder or,
b) if by means of a tag duly issued and bearing the serial number of
the Municipality attached or otherwise affixed to the dog, the said
dog is identified and returned to the owner, or an attempt is made
to return the dog to the ov01er, or the owner refuses to accept the
return of the dog, or fails to pay the appropriate fine or upon iden-
tification it becomes apparent that the said dog has been previously
apprehended and or found running at large in the Municipality the
said dog shall be forthwith taken to the pound authorized in that
behalf by the Council of the Corporation of the Township of Howick
and shall be held at such pound until the owner of said dog shall
have paid the appropriate fine as imposed hereunder and all costs
associated with the impounding of said dog but in the event that the
dog is not claimed and or the appropriate fine and costs are not paid
within 72 hours from the time of impounding the dog shall be de-
stroyed or otherwise disposed of as directed by the Council of the
Township of Howick or its duly authorized agent in that behalf and
all fines, costs and expenses shall be recovered from the owner of
the dog under provisions of the Summary Convictions Act, or
c) if the said dog cannot be identified by means of a tog duly issued
and bearing the serial number of the Municipality attached or
otherwise affixed to the dog the said dog shall be destroyed or
otherwise disposed of as directed by the Council of the Township
of Howick or its duly authorized agent in that behalf,
3) THAT any person being the owner or having possession or being
the harbourer of any dog found running at large and in contravention
of this By -Law shall be liable to a fine of;
a) $15.00 for the first such offence or;
b) 530.00 for the second or subsequent offence and;
c) all costs, charges or other expenses properly incurred by the
Municipality in connection with the boarding. Impounding or
other custody of the dog,
4) THAT all fines, cnorges or other costs referred to in number 3 above
shall be paid to the Township Clerk or other person duly outhorized
in that b•holf by the Council of the Township of Howick by the owner
of the dog or dogs found in contravention of this By -Law and a receipt
shall be issued therefor which receipt shall also when produced at
the pound evidence the owners compliance with the provisions of
this By-law and entitle the release of the dog Into his custody,
5) THAT a person or persons may from time to time be appointed by the
Council of the Township of Howick to enforce this ay -law and such
person or persons shall be known as an Animal Control Officer and
shall have authority to seize, impound or otherwise dispose of a dog
or dogs found in contravention of this By-law as hereinbefore pro-
vided and shall have authority to impose and collect the flnes,
charges and costs also hereinbefore provided,
6) THAT the provisions herein relating to d ggss running at large do not
apply to a hunting dog or dws while actual

7) CHAT This By -low supercedes all former my -Lows •n•cNd under
authority of this Act or Its predecessors and the same are hereby
rescinded and repealed:
8) THAT this By-law comes into force and takes effect upon the final
passing hereof and may be cited as "The Animal Control by-law".
Read a first and second time and provisionally adopted this 7th day of
May 1979.
