Metzger said there are two sets
of legislation that have to be met in
order for a re -zoning application to
be approved. The first is the town-
ship's secondary plan, and the sec-
ond is the provincial comprehen-'
sive policy statement.
The first zoning amendment on
the agenda was for the Warwick/
Johnston property at part Lot 31-32
of Concession 1. The purpose of
the by-law is to re -zone the former
Bluevale siding of the abandoned
CN railway line to permit the de-
velopment of two residential build-
ing lots. The by-law alsosets a min-
imum separation distance of 256
metres.
Metzger said that even though •
the county planning department
recognized the property as a single
lot, if township council accepted
the property as two lots, the plan-
ning department would abide by
the council's decision.
Council made a motion to accept
the property as two lots of record.
Metzger said it's usually not the
planning department's policy to al-
low for this type of development.
However, he added that the re-
zoning may comply with the town-
ship's secondary plan, and meets
the seven criteria in the compre-
hensive policy statement.
He added that the Ontario Minis-
try of Agriculture, Food and Rural
Affairs (OMAFRA).did not object
to the development of the property.
Township clerk -treasurer Nancy
Michie reported that the Huron
County Health Unit (HCHU) had
no objections as long as test wells
to five -feet in depth were dug on
each lot.
She also reported that OMAFRA
had no objections to the property
being considered as two lots.
The second re -zoning applica-
tion was from Steve Lubbers for
the north half of Lot 25 of Conces-
sion 9. The ,amendment to the
AG4-8 zone would no longer pro-
hibit the housing of livestock.
Metzger said that under the
present zoning. Lubbers is prohib-
ited from using the barn for keep-
ing livestock, but he wants to keep
veal calves.
He said the house was severed
from the farm land a number of
years ago, and re -zoned to prohibit
livestock.
However, Metzger noted that
there is a policy in the township's
secondary plan to allow for the
land to he re -zoned to its original
status, if the manure is disposed.

Lubbers said that he knew of
some AG4s in the township that
had no manure agreement. How-
ever, it was noted that most of
those were re -zoned prior to 1989.
Metzger agreed that titere could

railer rolls over
The driver of a tractor -trailer unit
was not injured allowing a one -
vehicle accident just north of North
Street, in.Turnberry Township, last
Tuesday.,
The accident was apparently
caused by the slippery road condi-
tions at the time.
Wingham OPP reported that the
tractor trailer, driven by Patrick Ge-
raghty of London, was southbound
on Hwy. 4 at „approximately 60 km/
h on a road surface that was wet
with slushy snow.
, The OPP reported that the trac-
tor -trailer unit left the roadway,
striking a hydro pole and rolled
over.
The trailer was owned by Frede-
rick Frieght Ltd. of Augusta, Maine
and was carrying auto parts.
There was no estimate of dam-
age to the vehicle and there were
no charges.
