Nail down all
costs in home
repair deal
Whether repairing a roof
or 'painting a porch, home-
owners hiring contractors
should be sure all costs are
nailed down in writing.
The wording in a contract
with a construction or reno-
vation firm is as important
as the design and planning off
the project 1 itself, say con-
sumer advisors with the
Ministry of Consumer and
Commercial Relations
(MCCR). Haste in setting up
a contract can lead to dis-
appointment with the quality
of materials, incomplete
work and unexpected ex-
pense.
The first step towards
avoiding problems is to de-
cide exactly what work is to
be done and how much you
can afford to pay.
A building permit may be
required before work can be-
gin. Check with your
municipal office.
"Then get friends to re-
commend a company,” says
Roberta Allan, chief con-
sumer advisor for MCCR.
"Don't just choose a firm at
random or base your choice
on an appealing advertise-
ment. Also, be wary of door-
to-door sellers canvassing
the neighborhood. Check
company reputations
through former customers,
Better Business Bureaus and
local chambers of com-
merce."
Companies that enter into
contracts with consumers
while away from the firm's
permanent place of business
must be registered and
bonded under the Consumer
Protection Act.,
Before signing a contract,
ask the seller for his regis-
tration number and verify it
by phoning the nearest
Consumer Services Bureau
of the ministry.
Always ask at least three
reputable firms to quote on
the job.
Once a company has been
selected, set up the contract,
perhaps with a lawyer's help
if it's a costly job.
The contract should cover
the type and amount of work
required, specifying mater-
ials to be used. Dates for
start-up and completion of
the project should also be
listed.
Check warranties and
guarantees carefully. Re-
member, they're useless if
the company involved' goes
out of business.
,Keep deposits to about 10
per cent and be wary of
firms -asking, for large
amounts of money as down -
payments to buy materials.
Reputable firms, usually
have enough credit to buy
the necessary supplies.
"We get many complaints
from people who have paid
deposits of'more than $1,000
to contractors who never
show up to do the work,"
says Allan. "The consumer
may only have a name and
phone number to go by. No
one can locate these com-
panies and the customers
never get their money back, _
Thousands of dollars are lost
every year."
Contracts for large jobs
may involve "progress pay-
ment" — installments to be
made as specific stages of
the work are completed.
Under the Construction
Lien Act, you are required to
hold back 10 per cent of each
progress payment until 45
days after the job is finished.
This ensures you cannot be
held liable if the company
doesn't pay suppliers for
materials. -
Keep an eye on the project
during construction, so . any
problems can be corrected
as they appear. But don't in-
terfere so much that the con-
tractor can no longer work
efficiently.
If you feel you have been
unfairly treated by a firm,
contact the nearest Con-
sumer Services Bureau of
MCCR.
You can cancel contracts
for more than $50 that were
signed away from , the
seller's permanent place of
business, by sending a re-
gistered letter to the com-
pany within two clear work-
, ing days of the date the con-
tract was signed.
The ministry has publish-
ed a booklet on handling
home renovations that pro-
vides general information on
contracts and specifics about
insulation, siding and paving
projects. For copies, contact
