Righting wrongs

Our judicial system is
based upon one very simple
principle: a person is in-
nocent until proven guilty,.
That is the way we have
tried to treat people accused
of every imaginable mis-
doing, from overstaying
their welcome at parking
meters to committing the
most heinous crimes in our
criminal code.
It has taken until now for
those in authority to recog-
nize that the same principle
should apply to taxpayers.
The new federal govern-
ment, acting on the recom-
mendation of its own task
force which operated while
the Conservatives 'were in
opposition, has promised to
create a law allowing tax-
payers to postpone paying
taxes in dispute until the
appeal is settled.
At the moment, until this
new legislation is passed,
taxpayers areforced to. pay
up even when they are ap-
pealing Revenue Canada
assessments.
Not only does that fly' in the
face of established legal
principle, but also it is just
plain misguided in a prac-
tical sense. In recent ap-
peals, Revenue Canada has
turned out to be wrong 80 per
cent of the time. That means
taxpayers, in many cases
small business operators,
must tie, up cash and re-
serves to.. satisfy what too
often turn out to be unjustifi-
able demands by the tax-
man.
To their credit, 'Revenue
Minister Perrin Beatty and
Finance Minister Michael
Wilson have moved swiftly to
right this wrong.
As significant are the
signals coming out tf Ottawa
that the entire tax system
must be simplified.This has
long been a priority for the
Canadian Federation of In-
dependent Business whose
65,000 members consistently
point to the tax burden and
government regulations as
their top two problems.
The message seems to be
getting through to Parlia-
ment Hill where Wilson, in
his recent economic state-
ment, called the tax system
overly complex end pledged
to introduce a package
designed by the. last govern-
ment to clear up some of the
mess. Civil servants have
also been told to find more
ways of cutting through the
tax regulation jungle.
Wilson said the tax system
'"imposes ans unnecessary
cost in time and money just
to understand and comply
with the law. And the more
complicated the tax system
is, the less effective will be
the investment incentives
contained in it."
Exactly.
That's what small busing
operators have been sayi
for a longtime. Over the last
few years, and in the
decades to come, small and
medium-sized enterprises
have been and will be ac-
counting for a large majority
of the jobs created in our
economy.
But every hour and every
dollar entrepreneurs spend
trying to decipher tax hiero-
glyphics means less time for
getting on with business, ex-
panding the firm, adding
new workers.
One measure in the new
tax package alone will save
small businesses $50 -million
a year in accounting fees,
That will free up a lot of
"those human and financial
resources we're counting on
to make a dent in the unem-
ployment numbers.
It is not the only answer,
but it is one way of helping
the moribund employment
scene regain its health.
