Last weekend was a treat for most winter weary citizens. Not too many folks, though, will wager that winter won't return for at least one more time before spring really sets in. In December of last, yea an all -party legislativ committee decided to d lay passage of th proposed marriage la reform bills to give intereste groups more time to mak submissions. Members wer torn between a wish to dela the legislation to provid opportunity for public input and concern that if th reforms were delayed the .might be stalled yet again b the intervention of provincial election. Followin mounting pressure, th committee agreed to ad vertise for public submission , and give clause by claus consideration to the bills in comreitteerather than in the House where the public cannot take part in the debate. The major proposals for consideration are: (1) the creation of legislative guidelines for the enf sharing of fa mil Y assets on to marriage break -down, and in aw, certain cases, other assets; oth (2) the creation of a new the kind of support obligation on me the part of each spouse •to wn, support the children of the een marriage and the other the spouse if he or she is in need, o when the 'spouse from whom rtn support is sought has the a on means; It (3) the replacement of d m- dower by the provision of of rights - for either spouse to s na a a p b d r L 114 Jack Riddell fl urge—Middlesex MPP TYPICAL BUNGALOW INSTALLATION responsibility for supporting the family, there is con- siderable difference of opinion about the best method of doing this. The "full 'community" system involved joint ownership and management f property acquired during marriage (including business ssets) and automatic equal haring on marriage break - own. "Deferred Com.-4.munity" of property involves eparate ownership and anagement of property cquired during marriage but utomatic equal sharing of roperty, again including the usiness, on marriage break - own. This latter was ecommended by the Ontario aw Reform Commission. Another possibility is in- stead of sharing all assets acquired since the marriage, legislation could prescribe that a single asset, the matrimonial home, be automatically jointly owned and managed during marriage and on marriage breakdown. The Province could, alternatively, adopt the English system of judicial discretion. During marriage ownership and management of property continue to remain with the spouse who paid for it. Upon marriage breakdown, a judge exercises a- discretion to divide all property, including business assets, following statutory guidelines, regardless of whether the property was .acquired before or during the marriage. A blend of the judicial discretion and deferred community systems results in what may be called the family assets approach. Family assets, that is property ordinarily used or enjoyed by members of a family for shelter, household, transportation, education, recreational, social or aesthetic purposes, would be ha,m1 equally_ unless the judge exercised his drseretion, along statutory guidelines to vary the share of family assets, or in unusual cases, to divide other assets. • Each of these possible alternatives would apply only in the absence of a marriage contract In essence, the proposed legislation -places the onus of responsibility for the support of children on both partners equally, and, provides that in common-law situations which have been in existence for two years, both parties have the same rights as married Persons. on remain in possession of and to re control dealings with the at matrimonial home and nd household goods; all (4) the recognition of tat marriage 'contracts between ed spouses who prefer to create or their own rules governing re economic relations. k, Ontario's current law of to separate property operates to of assign ownership of property to the person who pays for it. r, A married man's earnings e and property purchased from e- those earings belong to him e and a itiarried women's w 'earnings and property bought d with her earnings belong to e her. The apparent equality of e this system of property law is y not suitable for many e marriages. In what has been con- e sidered the traditional type of y marriage, the husband is the y breadwinner and the wife is a the homemaker who g ,manages the household and e -cares for the children. The - wife often ends up with s nothing because she has e neither earnings nor savings of her own. Her contribution as the homemaker and in caring for the children is largely unrecognized and consequently not valued in property or dollar terms.
