Planning bd. seeks legal
Qpinion on McGee property
The Goderich area plan-
ning board tabled a decision
on November 8 on the McGee
Motors , property awaiting
legal advi+rom . town
solicitor Dan Murphy. The
property once housed tilt
Colborne H $tai but ..the
building *as demolished by
the car dealership and the
land is now being used for
storage for new trucks.
Town council sent . the
matter to planning board for
a recommendation on what
action the town should take.
The present use of the
property does not conform
with°the town's official zoning
bylaw and no application has
been made to have the land.
rezoned to permit the storage
of vehicles.
Building inspector Rost
treckenridge. ,'brought the
matter to council's attention
claiming the present use of
the property contravenes the
town's 1972 zoning bylaw and
recommending the town take
legal action.
Planning board member
Elsa Haydonsaid she felt the,
matter never should have
come to ,the board. She said
no application has been made
for rezoning which is the only
reason the board should
become involved.
.She said any legal action
would have to be taken by
council and suggested that
the issue be returned to
council . advising them to
enforce their own bylaws.
Board chairman Dave
Gower said he felt it was the
board's duty to investigate
the legal' ramifications of -the
zoning issue and recommend
; to council what action should
or should not be taken. He
• said the board pays the town
cholars r established, solicitor a retainer for advice
and should get that advice for

council.
Mrs. Haydon said -she felt
the move was a delay tactic
pointing out that both council
and• planning board have the
same solicitor and that the
advice would be the same for
both bodies. She said: plan-
ning board was not taking the
same action as they had in the
past and was setting 'aa
precedent.
Mr. Gower said he felt that
-both —the --secretary- and—the
board were over -reacting and CUT
said he saw no point in
discussing • the matter until A
the legal advice is obtained.
He- added there was no merit .
in reading the board a letter FIGURE
from the God.erich
•Architectural Conservancy
Society on the issue. The
'society opposed the
demolition of the Colborne
Hotel and tried to delay the
use for the building could be
arranged. -
Charles Snell said planning
board should handle the
situation correctly and
quickly to avoid undue
hassles. He said the board
had never had a group of
'people opposing _ the
.destruction of a building and
concerning themselves with
the actions of the board.
Ken McGee,. a member of
the planning board, said at
—the time of the announdement
that the car dealership was
going to tear the building
down that the firm .planned to
use the lot for storage of
trucks.. He said his firm had
been using the land for 15
years for the same thing
when the hotel was standing'..
and no oneobjected.
Mr.- McGee did not take
part in the discussions at the
planning board meeting and
was challenged by Elsa
Haydon who felt that Mr.
McGee, by virtue of his
ownership of, the car
dealership, should declare a •
conflict of interest. Under the '
municipal act any `board
member or member. of '
council who has such a
conflict of interest must state
so at the outset of discpss ions
on the 'matter nand remove
themselves ' from anyin
volvement in th'e issue.
Mr. McGee said he was.
aware of the conflict and said
he intended to speak hie piece
on the ; subject r, nd then
remove himself frog further
involvement.
The.' board tabled 'the .
matter until their December'
meeting. Huron •County.

board that the: :county plan-
