What happens when a customer goes' bankrupt in his
business and owes money 'ona personal debt? Here is the
situationlin detail;
1 run a service station and; .I grant credit to local
businessmen, most of whom i regard as dose friends: Up
I till. now I have •never had any serious problems but 1 have
received. notice that'•a--certain businessman has gone
bankrupt and his bill with me is over $500.00., Front what 1
can gather he has few assets, and I've been told that I
• won't likely receive more than $50.00 on this debt:
What t need to know is if 1 can sue this man. personally
for the full amount, or must: I collect from his firm?
You can sue the.businessman personally, and likely get judg-
ment ag.ainst
udgment'ag:ainst him, but collecting could be another thing.
if the use of a car was'absolutely essential for; his business then
any action. against him personally will be fruitless.. as the
bankruptcy discharge will be all encompassing: However, if the
use of the car -was merely for his own personal convenience then
it: would fall under -S1148 (1) (g) of the Bankruptcy,' Act as :a
"necessary ofrlife" and thus survive the bankruptcy discharge.
If this is so you cpuldlstillcollect from the debtor personally, no.
matterwhat happened.fo his

No, you will not. The 5.235: offense does not require a 5.234
conviction, but Merely charge being laid under S.234 andthat
fhe officer had reasonable pnd.probable grounds to believe the
accused had committed the S.234 offence. `
Not only is refusal to Live ct breath sample a separate offence
in itself, but it carries a minimum penalty of a $50.00 fine and
this will result in a• minimum licence suspensioniof 3 months.
Therefore, if you areever- asked to give a sample of breath
