I've often heard about people who have just been'in-
volved in.a cag'accident making damaging statements
to the police while they were in shock: What is anyone
involved in an accident obliged to tell the other driver?
The police? ••
Section 740. o•f; the Highway Traffic Act.,slates that any
driver involved in an -.accident; is obliged'. to give 'the .name
and address 'of 'the the registered owner of the vehicle to any
police officer, or anyone else, who has either witnessed or
sustained loss in the accident.
Besides this, the investigating officer willask to see your
driver's licence, thevehicle registration and proof of in-
surance. He will also askfyou fora brie:f'explcination of how
the accident occurred: if dt this time you are not quite sure of
any details, don't try to adlib, end if you feel,groggy from as
•blow on thehead, say so.
If there is something which you feel could be.damaging to
you, tell the officer that.you do hot wish to comment further

A piece of plaster fell from the ceiling of my apart-
. rnent recently and hit me on the head. The aggravating
thing is that I had toldmy.landlord'several times that
the ceilingwas loose and dangerous. •
The falling plaster gave me a nasty cut which took
five stitches. to close; and also 1 had to send my carpet,
away to GET THE BLOOD STAINS OUT . '
When I told the landlord-that--1-wanted some compen-
sation,: he told me'to' look at my lease. There 'was a
clause there saying that he:wps notresponsible or liable
in any way for personal Injury, dearh or da1nag•e to the
property, even if it Was his fault He says I signed the
lease, so therefore, have to agree•to'the terms. '
Is there anything that [can do? •
Normally such a term in 'a contract' would be binding on
you. However. a. residntial tenancy is a'special case. Under the • ai
Landlord and Tenant Act of Ontario the landlord IS responsi-
ble
for "providing and maintaining'the.rented premises in.,a
good state of repair.” (s.96(1)') ` •
.Another section of the act states that neither the landlord
or the tenant can "Contract out"of this duty. ,
A recent case in Ontario High Court decided that a tenant
could recover damages in o case like this ev.en where the
lease had a similar provision to yours.

The compressor on our-free'zer broke down but we
didn't' know kecouse the ir'dicator light was still on. By
the time we 'realized that something was w,rong,"it was
too late and our food was all spoiled. .
1 have tried• to get a cheque for $104.18 from the
manufacturer, but so far in vain.- '
A' serviceman coiled on, us right away and .repaired.
the freezer. Her said he would report our loss to the com-
pany, and so tat; did' the store that we purchased -the..
freezer from,.but that was; six months ago and I'm get
ting very fed :up with na action after'alt this time.
Our letter from the manufacturer brought hack n prompt
reply»fhat.they were ''quite ipmozed' to get our le'ter on. our
reader's behalf, as they claim that they were NOT i,tior•med
`by anyone, either yourself, the store or the .serviceman about
your predicament. •
They state very emphatically, however, that they .w,ll'most
•cerfainly honour the g'ua'rantee on their machine.
As soon as you complete, and ref -urn the officio/Claim form
that has been 'nailed out 16 you, they. "will he happy to send
. you on o cheque for the full amount,"
It's obvious that somebody goofed here.' but as the old
saying goes.... ;Alt s well, that end's well.
