(Photo by Rob Bundy) Bruce Hydro line may lead to expropriations On February 20, 1987, approval was given for a new hydro transmission line to run from the Bruce Nuclear plant located north of Kincardine to Komoka, in the Lon- don area, and from Komoka to Nanticoke. Several appeals to the Ontario cabinet were submitted, but cabinet gave its ap- proval to the route during the week of May 26, 1987. In order to construct this new transmis- sion line, Ontario Hydro will be required to acquire easements over lands throughout the affected area from the land owners and it is estimated•that 1,400 property owners will be directly affected. Ontario Hydro will now, in all likelihood, contact all'of the parties affected by the new route and at- tempt to acquire an easement over the land from the owners. If it is not possible to acquire an easement over •all of the lands required, Hydro would then register a plan of expropriation which would set out the lands over which easements are .being ex- propriated by them. Ontario Hydro will likely set up informational meetings throughout the affected areas to detail the plans and their' desire to acquire easements over the necessary lands. Under the Expropriations Act, an owner of lands that has been expropriated is en- titled to compensation from the ex- propriating authority for those lands' or easements over their lands, which com- pensation is based upon several factors set out in the Aet. Ontario Hydro will attempt to acquire easements over the land prior to it being expropriated. If a settlement can- not be reached with all of the land owners, PUBLIC NOTICE TAKE NOTICE that the Council of the Municipal Corporation of the Town of Goderich proposes to enact a by-law to stop up and close that part of Mooney Street, being a street in the Town of Goderich, set out and described as follows: That Part of Mooney Street located south of Mitchell Street in the In- dustrial Park, within Part No.'s 19 and 35, Registered Plan 22R-1172 deposited in the Registry division of Huron and shown on the map below. The proposed by-law will repeal By-law No. 46 of 1987 and will come before the said Council for the Corporation at its regular meeting at the Town Hall in the Town of Goderich on the 17th day of August. 1987 at the hour of 7:30 o'clock p.m. and at that time, the Council will hear in person or by his counsel, solicitor or agent, any person who claims that his/her land will be prejudicially af- fected and who applies to be heard. The first fac- tor illi determining the compensation is,"of courte, the market value of the land., A land (owner is also entitled to any damages that Imay be attributed to "disturbance". The Board has held that disturbance damages include business losses suffered by land owners and additional costs incur- red if relocation of -a business was re- quired.. Under this heading of disturbance damages, awards have also been made for cost4 of removing debris left oh the 6Wners° land,( moving costs and the time lost by the owners. Mother heading under which compensa- tion is determined is "injurious affection". Injurious'affection applies to land owners who have had part of their lands taken but not all of them. The amount compensable for injurious affection is determined by assessing the reduction in the market value of the landwhich remains. The Board has allowed for losses arising from loss bf access of reduction in access,,either to a highway or adjoining• land, for loss of trees and landscaping and in some cases for kbsses'and damages due to the proximi- ty to hydro transmission line towers. Where there has been no agreement as to 'the compensation to be paid to the owner, Ontario Hydro will be required to serve the registered owner with an offer of an amount in full compensation and to offer the owner immediate payment of the total . amount of such offer. This, offer is, however, without prejudice to the rights of the land owner to dispute the offer made. by Ontario Hydro. This would allow the land owner. the additional remedy of disputing the offer if he determines that the easement over the land is worth more than what has been offered. A land owner would determine the worth -of his -land over -which-an asement-isbe=- ing expropriated by engaging a qualified land appraiser who uses several methods to determine the value of the land. If an offer from Ontario Hydro was not accepted and it was determined that On- tario Hydro did not intend to raise the of- fer, the land owner would then be entitled to commence proceedings before the On- tario Municipal Board: At this point, the land owner would probably have retained - legal counsel and would have had at least one appraisal done of the property which would indicate that the offer made by On- tario Hydro was too low. As with most matters which are litigated between adverse parties the time frame from the date of expropriation to the date that the matter is finally heard by the Board may be several years. However, the advantage to the owners is that they have already received some compensation from Ontario Hydro. If the land owner receives at least 85 percent of the amount offered by the expropriating authority; he is then also entitled to reasonable legal, appraisal and other costs incurred by him for the pur- poses of determining what compensation he is entitled to. In addition, the owner is usually entitled to interest on the sums at the rate of 6 percent per year calculated. from the date' of the expropriation, although the Board has the discretion Co raise the rate of interest up to 12 percent where the Board feels' a delay in determin- ing compensation is attributable in whole or in part to the expropriating authority.
