Expropriation issue cause

John Deeves noted that providing parking
for OMAF could set a precedent. He said
that Bank of Montreal employees are also
concerned about limited parking near their
work and if OMAF received special parking
permission, soon others would also be
• seeking it.

Councillor Jim Hunter further noted,
"The problem is that OMAF needs parking
because Of their business and their situation.
,OMAF has suggested one solution, want to,
help OMAF but let's look for a non-political
solution." •
Councillor _Hunter suggested that a
council committee meet with the OMAF
building owner, in an effort to obtain extra
parking. •
He also suggested, "Maybe weshould look
at OMAF as one of the town's major
industries, we'd help any new industry
coming to town."
Mayor Archibald supported the OMAF
request and explained. that their situation
was different from other core area
businesses. He said that businesspeople who
supply parking for their customers hope to
benefit directly from that. OMAF staff are
working to provide a needed service.
Councillor Charlie Burgess did not offer
his support to the OMAF request. In fact, he
said to Mr. Pullen, "It's gOtten to be a sad
state of affairs when a government office -
can use itsPowers and threaten to pull out."
Other council members firmly disagreed
that OMAF threatened to leave Clinton,
however Councillor Burgess added, -"You're
(OMAF) asking for preferential' treatment
for a few government employees. If we give
it to - you then we'll have to give it to
everyone."

Councillor Rose ry Armstrong
emphasized that OMAF was not requesting
free parking, but was quite willing to pay for
the service. Mr. Pullen noted that the office
had a $500 grant from the County of Huron
which could help finance this.
Previously parking sticker prices ran less
than $15 a car, per year, but Councillor Ross
Carter suggested that this fee was too low
and council could raise it substantially.

"If erosion control is required at a future
date, I would assume it would likely be rip
rap, but I don't know the cost of rip rap
because I've had no experience with that,"
he noted.
Mr. Rogerson's petition also asked about
the feasibility and profitability of a possible
marina on the site. The petition noted that
council should remember 'a marina was
forced to go bankrupt a few years ago.
The Reeve felt council should not address
Mr. Rogerson on this matter because they
did not intend to build a new marina:
"On the comment about one going
bankrupt, 1 am fully aware of that, but there
are four marinas operating on the river and
I believe you are the co-owner of one of them
and you're operating quite successfully,"
the Reeve commented.
Another question asked if council planned
to announce, publicly, its total plan for the
river.
All the councillors agreed the plan had on-
ly been partially developed, so an announce-
ment forthe total plan was not possible.
Dave Johnston said council has always
made public their intentions with regard to
the river area. He said they meet with the
Ratepayers Association who in turn ask
questions and council try to give them the
answers. He also agreed with councillors
that a total plan had not yet been adopted so
a public announcement was impossibkat
this time. He added that during a May 5,
ratepayers meeting, a long term plan was
one of the topics. of discussion this was
discussed so a formulation of some type of
plan for "public owned land'.' could be deter-
mined.
"And I specify public owned because
some people seem to have a feeling that the
village and all the taxpayers in the village
are trying to steal your marinas or tell you
how to run them," stressed Reeve Johnston.
"What the citizens are saying is they want a
say on the public owned land the village of
Bayfield own."
Reeve Dave Johnston decided to answer
the sixth question of whether council plan to
.go before the Ratepayers Association with
all the facts of the expropriation, before con-
tinuing actions. The letter also asked if the
reported cost of $60,000 was an accurate
figure.
The Reeve said he never stated it would
cost $60,000 but he did ask if the ratepayers
would agree on spending up to $60,000.
"I would appreciate you (Mr. Rogerson)
getting your facts right," added the Reeve.

Court's ruling to quash the expropriation. It
also asked whether council was receiving
expert advice on the matter.
The Reeve said he was not going to com-
ment on the Supreme Court's decision but he
did say it was quashed on a "Legal
technicalilty". He said council received
their information and advice from the best
people wbo-"seem to be able to dolbe best
3ob". He added that most ,of thelradvice had
corm from the PayrteldAusable Con-
servation Authority andsome legaLp000le.
Andy Turnbull has continued to clear the
site by cutting down Older larger trees to
allow ',sunlight tomob the younger trees
and to eliminate extra weight on the river
bank. He said be Ls willing to go to any ex-
pense, including erosidn control if it is need-
ed.
"I don't want to disrupt anything
natural," he said. "I'm willing to pay for the
preservation."
Mr. Turnbull said right now all he is con-
cerned with is receiving a building permit so
he can go ahead andtuild his large cottage
on stilts.
"I need my property, it's important to
me," he stressed.
The expropriation proceedings will soon
be rehashed; starting with the re-
publication by the Village of Bayfield for the
expropriation of the property.
When the resolutiohwas passed by council
at their May 7 meeting they decided to place
notices about its intended expropriation in
upcoming issues of the Zurich Advance and
,,The Clinton News -Record. The, adver-
tisements will mention the possibility of a
public hearing into the expropriation at-
tempt.
