The OPP officer who gave testimony, stated that evidence of the accused exceeding the posted speed limit of 60 MPI,, was obtained by a stopwatch. The OPP officer took the stop. watch readings from an airplane _while -flying over ...Highw y...4, - along which the motorist 'was travelling. The accused Motorist's speed was clocked at 12.5 seconds over two: separate 1/4 -mile zones, which indicated'a speed of 72 MPH." The London Tnotorist based his 'not guilty' plea on the accuracy of the stopwatch re. c6rdings. He claimed that slight time delays could occur between the activating and deactivating of the stopwatch which might result in distortion of his driv- ing speed. - Magistrate Guardhouse did not accept the accused motor- ist's objections to the OPP officer's stopwatch method for obtaiding evidence of speeding.
