The secretary, Mrs. N,ackson, read letters of appreciation and thanks from the Board a Directors for the Auxiliary's contribution of $1,000 to furnish a room in the new wing, and froom the nurses for the assistance given them bymem- bers sof the Auxiliary at teir an- nual dance. Magistrate I), E. Holmes ordered the confiscation of 7445 bottles of beer and ale and a part bottle c whiskey found on the premises when police raided it en the after- noon of Friday, August 23. Defence counsel Robert Barnes; of Windsor, submitted that there was "not • a tittle of evidence" to prove that the liquor was found in a place where the accused was, not entitled to it. But Magistrate Holmes stated firmly that as far as he 'was con- cerned, "There is only one logical conclusion from the evidence , that he was running a bootleg joint." In the second part of the crown information, it was charged that Pysaniuk had been convicted be- fore for keeping liquor for sale, thus making him liable to a greater penalty than if this was a first offence. Moves To Quash Before his client was asked .to answer to this second part, Mr. Barnes moved that this portion of the information be quashed "as being misleading and vague." He pointed outthat the written information lacked details, failing to use Mr. Pysaniuk's name and failing to mention the magistrate who allegedly 'convicted him be- fore. He pointed to other omis- sions also and submitted that it was now too late for the inform- ation to be amended. After considerable discussion, court was recessed for five minutes and the information was changed to include the details which Mr. Barnes said should notave been omitted. M. Hall said that the premises was raided by Con- stables A. South, G. McIntyre, M. Horan and himself. In one room, he said, there were five or six persons . at tables, some. with glasses and bottles of beer in front of them. Questioned by the crown attor- ney as to how he knew the bever- ages were intoxicating, the chief said that, in the interests of the investigation, he bad sampled one bottle before the hearing opened. To obtain further evidence, the chief had also sampled a part bottle of whiskey found in the refrigerator on the raided pre- mises. "That didn't .reduce it materi,al- ly- °' asked Crown Attorney Hays with a smile, "No, sir," replied .the chief. The eourt was :lrformed that the seized liquor had been kept in the local police office since the raid. Asked if he had seen any mem- bership cards at the Park House, the chief stated, "I didn't see any membership Cards, but there was a book there with !Nines and ad- dresses in it." He said that he saw no other form of record. Under cross-examination, the chief said he had not read out the search warrant but had held it up "a minute anyway" for Mr. Pysaniuk to see. Questions Validity Said Mr. Barnes: "My strong con- tention is that the officers did not have a proper search warrant." He pointed but that. the search warrant was issued as a result 'of information laid" before only one justice of the peace. ,Constable McIntyre, under cross- examination, said that he had talnp- ered with Mr. Pysaniuk's motor vehicle on orders. 'He had .pulled out a wire so that the vehicle would not run, When Crown Attorney Hays moved., to call Constable Horan to the witness stand, the magistrate stopped him, saying he had heard sufficient evidence. He indicated there would be a conviction unless the defence offered rebuttal. Mr. Barnes submitted that the onus of proving "beyond a reason- able doubt" had not been discharg- ed, but the conviction followed. Mr. Pysaniuk did not offer any testimony on his own behalf. U 0 0.- Abducte �ir1's Parents' Attitude Surprises Court For the abduction of a 13 -year- old Clinton girl, Lawrence Jamie- son, 35, of R.R. 1, Goderich, was sentenced to two months in jail by Magistrate D. E. Holmes here last Thursday. "I'm surprised the parents al- lowed ;this child to go with you," the "magistrate told Jamieson when he appearedfor sentencing. The magistrate said he couldn't understand why a man of the ac- cused's age would do what he had done to "an immature child." Charges of indecent assault and contributing to juvenile delin- quency were withdrawn by the crown. Evidence concerning the case was heard earlier in court at Clinton. Reviewing the evidence, the magistrate noted that Jamieson had taken drink to the residence oc- cupied by the girl and her parents. He stayed all night and had con- sumed a considerable quantity of alcoholic beverages by the time he was ready to leave the next day. Then, instead of taking the girl to his home as he had indicated he would! Jamieson had taken her on a trip to London, said the magistrate. In London, the car containing Jamieson and the girl was stopped by detectives. After questioning, Jamieson was brought back -to Goderich and lodged in Huron County Jail. According to police, about 12 hours elapsed between the time the pair left Clinton and the time the pair was stopped by the detectives. While Jamieson had made cer- tain, advances, according to the girl's evidence, a doctor stated that she had not been harmed.
