Local councils getting
short end of the stick?
Some say MPPs get more leeway from conflict legislation
EXETER - The province's new
conflict of interest legislation has
long been a thorn in the side of mu-
nicipal council members. Now that
the legislation is nearing Royal As-
sent, a few have even more reason
to feel stung.
Some are accusing the province
of setting standards of honesty for
municipal politicians much higher
than those for Members of Pro-
vincial Parliament.
Exeter town council Monday eve-
ning was referring to an editorial in
Municipal World, in which there
are 20 glaring differences in the
standards set for local elected of-
ficials, and MPPs. All suggest the
MPPs are being more leniently
treated.
The Local Government Dis-
closure of Interest Act, part of Bill
163, was enacted on December 9.
Two weeks later the provincial par-
liament gave first, second and third
readings to the Members' Integrity
Act. Municipal World notes that
the first bill was given public hear-
ings and much scrutiny, but the sec-
ond was not.
"I was outraged at the differ-
ences," said councillor Robert
Drummond, who said the upshot is
that local officials will have to dis-
close far more of their affairs to
public scrutiny than MPPs, and

Klopp is opening up the jobs
of enumerators in the next
provincial election to vol-
unteer organizations.
Klopp says that taking on
the tasks of enumerators, dep-
uty returning officers, and
other paid election positions,
non-profit organizations can
use the fees as "unique fund-
raisers" for their activities.
"Although members would
be hired as individuals, this
project will give them an op-
portunity to raise money for
their organization and will al-
low more people from the
community to have a part in
the election," said Klopp in a
release from his office.
Klopp points out that this is
not a suitable activity for chil-
dren, as it requires mature
people with good skills for
meeting people. And since
enumerators must be phys-
ically capable of canvassing
on a doo o -door basis, a ve-
hicle will be needed in most
cases.
The MPP also stresses that
these are not political jobs, as
all individuals would be
working for the Chief Elec-
tion Officer for the Province
of Ontario, under the super-
vision of the Chief Returning
Officer for Huron.

in enumerating in their arca is

release suggests this should
be done "as soon as possible".

an election within seven
months. but many observers
expect an election as soon as
this spring.

For instance, if a municipal coun-
cillor is found guilty of misuse of
insider information, they are sub-
ject to the Provincial Offenses'Act,
and fines up to $5,000. MPPs,
however, in the same circumstance
are dealt with by the Integrity Com-
missioner.
The new conflict of interest regu-
lations have also taken away the
ability of a municipality to insure
its council members against errors
made in good faith. That saving
provision, however, was added to
the regulations concerning MPPs.
"They'll have that kind of pro-
tection that you don't" town ad-
ministrator Rick Hundey told coun-
cil.
The Association of Municipal-
ities of Ontario is pushing to have
the hill's proclamation stalled, in
light of these discrepancies. AMO
was apparently promised by the
government that the new conflict of
interest regulations would make lo-
cal council members more equal in
status to MPPs.
"Are we going to do anything
about it?" asked mayor Ben Hoo-
gcnboom.
Drummond said it amounted to
making municipal councils "a sec-
ond-class government".
"We protested this damn bill so
much 1 don't know much more that
we can do," commented councillor
Bob Spears.
Council, however, agreed to send
a letter of protest to the government
over its hill.
