EXETER - In Provincial Court in Exeter on July 23. Judge Eleanor
Schnell sentenced one person to a jail term, fined 10 others and issued a
suspended sentence. Mary Dionysakopoulous represented the Provincial
Crown tiled Michael Donnelly was the Federal Crown.
Suspended driver jailed
Patrick Kyle of R.R. 4, Egmondville
was sent to jail for 15 days after pleading
guilty to a charge of operating a vehicle
while his licence was suspended.
Kyle was convicted of drinking and
driving in Sarnia on January of this year
and had his driving privileges suspended
for one year. Less than four months later
he was stopped by police in the Hensel' area and did not have a proper li-
cence.
At 12:10 a.m. on May 4, 1996, a vehicle driven by Kyle was spotted by
police travelling southbound on Highway 4 at a high rate of speed. On fol-
lowing the vehicle until it parked in Hensen, the police officer teamed a
valid driving licence could not be produced.
In handing out the jail tenn, Judge Schnall said, "'Ike previous court or-
der was deliberately flaunted. " The jail term will be served intermittently
from 7 p.m. each Friday evening until 7 p.m. each Sunday evening. Kyle's
licence will be suspended for 12 months to run consecutively to the first
order.
A narcotic charge
Ben Johnson of London was fined $110 on a possession of a narcotic
charge.
Johnson was arrested at 11 a.m. on November 4, 1995 when he visited
the Exeter OPP detachment to present proof of having insurance on his
vehicle.
While in the station Constable Herbert detected an odor of marijuana on
Johnson's person and a search of his vehicle revealed a five gram tin of the
narcotic.
Fined for mischief
Tracy Procop of Komoka was fined $110 after she pleaded guilty to a
charge of creating mischief under a value of $5,000.
The accused admitted to smashing the safety glass in a door at Gar's Bar
and Grill in Exeter on December 24, 1995. During the Christmas Eve inci-
dent the accused became argumentative and when asked by the owner to
leave, kicked at the glass door.
In making her decision for the modest fine, Judge Selman said, " I am
taking into consideration the fact you made restitution of $195.50 on De-
cember 27, almost as soon as possible."
Over .80 mg. conviction
Robert Regier of R.R. 3, Zurich was fined $550 for operating a vehicle
while his blood alcohol content was over the legal limit.
A vehicle driven by Regier was stopped by police officers on routine pa-
trol in Hay township at 9:45 p.m. on June 14, 1996 for not having a tail
light on the vehicle.
The court was told the accused had an obvious odor of alcohol on his
breath and other signs of impairment. At the Exeter OPP detachment,
breathalizer readings of 1.50 and 1.50 mgs. were recorded. Regier's driv-
ing licence was suspended for 12 months.
Takes vehicle without permission
Paul McNamara of Craig Street in London was fined $400 for taking a
vehicle without getting consent from the owner.
At 11 p.m. on May 22, 1996, McNamara is alleged to have taken the
keys to a van from the desk of his boss Copp's Buildall in London. Ac-
companied by his girl friend, he drove around London and then went to
Grand Bend.
They intended to be back at his place of employment by 2 a.m., but on
the way back on Huron Road 4 in Stephen township, the accused fell
asleep, lost control of the vehicle and it went 24 metres into a plowed
field. The van was a total loss.
Drinking,:da4ving film
Three other persons were fined on charges of operating vehicles while
their blood alcohol content was over the legal limit of .80 mgs.
Heather Hutchinson of Grand Bend was fined $500 after pleading guilty
to the charge against her and her driving privileges were suspended for 12
months.
The vehicle driven by the Police found Hutchinson to have an odor of al-
cohol on her breath and other signs of impairment. The accused was
stopped at 5:03 a.m. on June 15, 1996 going the wrong way on Anne
Street in Exeter.
The court was told Hutchinson was very co-operative with police. Brea-
thalizer tests at the Exeter OPP detachment revealed readings of 1.50 and
1.30.
Judge Schnall assessed exactly the same penalties against Tracy Roche
of Zurich on similar charges of drinking and driving.
On April 20, 1996 at 1:20 a.m. the accused was stopped by police during
a R.I.D.E. check at Huron Park and was found to have an odor of alcohol
on her breath and other signs of impairment.
At the Exeter OPP detachment breathalizer readings of 1.80 and 1.70
mgs. were recorded.
After a short trial, Barry Baynham of Motz Boulevard in Exeter was
found guilty and fined $550 and had his driving licence suspended for 12

months on a charge of drinking and driving.
At 1:50 a.m. on February 18, 1996, Baynham's vehicle was stopped by
police only a short distance from his home. Police had followed the ac-
cused's vehicle south on Main Street and east on Sanders Street.
OPP Constable in training Shawn Blaj was accompanied by his coach
officer Constable Rob Kem. Blaj testified that Baynham had an odor of
alcohol on his breath and glassy eyes.
Lawyer Kim McLean based his defence on the method of questioning by
the young officer and whether or not the accused was asked if he had a
drink within 15 minutes previous to being stopped. Baynham testified that
he had not been asked the question and the officers said they did.
Judge Schnall said she was impressed by the replies by the three wit-
nesses, she did not feel that asking or not asking the question of the previ-
ous time of drinking was important.
Dangerous driving fines
Patrick Nigh of Huron Park was fined a total of $2, 100 after pleading
guilty to three charges arising from an incident which occurred on May
29, 1996 mostly in the police village of Crediton.
Nigh was fined $1,100 for dangerous driving, $500 for failing to stop for
police and another 5600 for operating a vehicle without having insurance
coverage. Three other charges including speeding and police pursuit were
withdrawn by the Crown.
OPP Constable Penn while on radar enforcement on Huron Road 4 ob-
served the accused's vehicle travelling at a high rate of speed, just east of
Crediton.
The court was told Nigh's vehicle swerved to avoid a mishap and ap-
proached Crediton at speeds of 140 to 160 kilometers an hour where a ball
game was in progress and pedestrians were on the street. Both vehicles ex-
ited west of Crediton at speeds up to 180 kilometers per hour.
Nigh said he was scared and panicked because he did not have insu-
rance.
While the Crown asked for a short, sharp period of incarceration, Judge
Schnall said it was a borderline case and she decided against a jail term be-
cause there was an early plea of guilty and no drinking involved. The
judge added, "It was a case of horrendous driving and the lives of a lot of
people were endangered. It could have had serious consequences."
Nigh's driving licence was suspended for two years.
Suspended sentence
Judge Schnall assessed a suspended sentence and probation of 18
months against Steve Kirk of 110 Main street, Exeter on a charge of
breach of probation.
Kirk was placed on probation of two years in November of 1994 on
charges of threats and harassment broke that probation order on May 5 of
this year in Exeter.
Linda Crerar of Adult Protective Services recommended that the ac-
cused should have psychological and neurological assessments and report-
ed he is now under 24 hour supervision.
Fined for failing to attend
Sean Wolfe of Port Elgin was fined $100 for failing to attend court when
directed to do so and placed on probation for 12 months on a charge of
possession of stolen property.
Wolfe failed to appear in Exeter court on April 23 of this year to face
charges of possession of two bikes allegedly taken from the Exeter home
of OPP Constable Penn.
Fined for assault
Judge Schnall fined Gerald Cottle of R.R. 1, Woodham $220 and placed
him on probation for 12 months, The Crown withdrew an additional
charge of breach of probation.
In making her decision, Judge Schnall said, "You have had three drink-
ing and driving charges since 1986, Alcohol seems to be a factor in your
life. I urge you to get some assistance regarding this problem."

Consultants present
Exeter study proposals
EXETER - Four of five con-
sultants who were sent calls for
"Made in Exeter" internal study
propsals have responded. Ac-
cording to PUC Manager Sher-
man Roth, the highest quote was
discarded and two consultants
were asked to present their pro-
posals on Tuesday night.
A decision is expected to be
made quickly in order for the
study to get underway within the
time -line set by the steering coni-
mittee.
The study is a joint effort of the
town and PUC, which will share
25 per cent of the consultant
fees. The goal of the study is to
determine if a re -organization
and re-engineering of local gov-
ernment will yield comparable or
greater efficiencies than amal-
gamation. An amalgamation
committee consisting of Grand
Bend, Bosanquet, Exeter, Stephen
and Usborne has initiated a study
to examine the merits of re-
structuring involving these mu-
nicipalities. A preliminary report
is expected to be completed by
the end of August.
Tn order to allow a compari-
sion to be made, it is hoped Exet-
er's internal study will be com-
plete before the amalgamation
committee sends its report to the
Ministry of Municipal Affairs
Exeter's study will evalutate
structure, basic organization and
service levels as well as delivery
options and processes. The con-
sultant will he required to rec-
ommend a preferred re-
structuring plan identifying
productivity improvements, cost
efficiencies and staffing, tech-
nology. operational and pro-
cessing requirements. The study
will also identify and assess vi-
able options for organization and
operations as well as determine
and compare productivity im-
provements in restructuring. Op-
tions will include a town/PUC
(hydro and water) merger; a
town -water merger and a re-
organization of town departments
only including, administration,
public works, recreation, tire and
cemetery.
