THE ONTARIO MUNICIPAL BOARD hereby appoints Thursday,

time) in the afternoon at the Lucan Community Memorial Cen-
tre, Leprechaun Hall, 263 Main Street, Lucan for the hearing
of these appeals.
If you do not attend and'are not represented at this hearing,
the Board may proceed in your absence and you will not be en-
titled to any further notice of the proceedings.
In the event the decision is reserved, persons wishing a copy
of the written decision may ask the presiding Board Member

Explanatory Note
The purpose of the Hearing is to deal with 2 appeals lodged
to the Township's new Comprehensive Zoning By-law adopted
on September 2, 1986. A number of minor, technical changes
to the By-law will also be considered. These latter changes
would overcome concerns raised by the Ministry of Municipal
Affairs, as well as correct certain typographical and drafting
errors discovered after the by-law was adopted.
The first appeal hos been lodged by William Chamberlain,
owner of a vacant parcel of land (legally described as port 6,
R.P. 33R)091) on Chriselle Place in the hamlet of Clandeboye.
Although the Chriselle Place Road allowance has been transfer-
red to the Township, the road has yet to be assumes or main-
tained by the Township as a public road. Hence, the Township
has zoned these lands Holding (H) which prohibits the construc-
tion of buildings and structures until certain conditions hove
been fulfilled. Mr. Chamberlain has requested that the lands
be zoned Urban Residential (UR).
The second appeal has been lodged by Peter and Erica Nippa,
owner of lands lying adjacentlo a privately owned and operated
landfill site in Lot 24, Concestion 3. Mr. and Mrs. Nippa are re-
questing the inclusion in the by-law of a 500 foot setback bet-
ween their property line and any act of landfilling on the adje•
cent properfy. If is the Township's position that the municipali-
ty does not hove the authority to impose such restrictions as
the operating regulations pertaining to licensed landfill opera-
tions are the jurisdiction of the Ministry of the Environment.
