Open letter to the citizens of Sl..
Marys and Area:
In my previous open letter. 1 ex-
plained the background of the change
in conviction of Raymond Bruce
Rueger from first-degree murder 10
second-degree murder. On March 7.
1985 at a hearing of the Court ot Ap-
peal of Ontario, before judges Arnup.
Martin and Lacourciere, a new
sentence was handed down. The fami-
ly Of Marilyn Arthur were in alien-
: dance at the hearing.
During this hearing, the facts of the
case and the reasons for substituting"
the conviction for second-degree
murder were not outlined as it had
been done in the previous hearing.
The judges noted that the murder was
a brutal killing of a young woman
whom the appellant had never seen
before. They reviewed the appellant's
past history of assault causing bi►di-
ly harm in 1971 and again in 1976.

Rueger suffers from a personality
disorder ot long standing and that he
has a propensity for assaultive
behaviour that is sexually motivated.

believes That the appellant is al tinges

pulses and that alcohol is a tactor. 11
is the opinion of the psychiatrist -that
Rueger is not a promising can-
didate for treatment.
The matter before the court was not
whether the appellant ought to be
parolled. but rather at what time he
should be considered for parole. Rav-
ing 'considered all the -issues. the
Learned judges affirmed, the lite
sentence and set the number or years
of imprisonment without etigibilit'
for ptirole for 18 years.
It is my opinion that the process of
law has been followed and a
reasonable judgement passed. This
does not alter my opinion that the in-.
itial reduction in sentence was based
on a weak argument that Mr: Rueger
was not- responsible for his .lotion
because of his alcohol consumption
