Beach dispute
back in court
SARNIA -. The legal battle over ownership of the Grand Bend
beach is back in court this week after a three-month adjournment.
Malcolm Archie Gibbs is continuing his pursuit for legal recogni-
tion of his -claim on the 300 -metre strip of beach between main street
and the government pier.
Gibbs also seeks S2 million in damages for trespass and loss of in-
come; acid another $500,000 for punitive damages against_the village
and pmvincc. - - -
The Village of Grand Bend hopes to prove Gibbs' decd worthless
on the grounds that all banks and beds of waterways remain crown
• property. ,
Before the adjournmcn', .Gibbs'. lawyer Mikis Mclnitzcr brought
forth testimony from several witnesses who claim they believe the
Gibbs family owned the beach at least 50 years ago.
Grand Bend's lawyer, Dan Murphy says he will call 20-25•witncss-
cs who claim they always believed the beach was -public property.
Should Grand Bend lose is beach to Gibbs, the village and village
•businessmen claim the arca will lost its viability as a major tourist
attraction. -
On Monday it was reported Gibbs' counsel unveiled plans to divide
the beach into lots for commercial and residential development.
Should thc court rule in Gibbs' favour, it is expected the province
will appeal, or expropriate the beach property from Gibbs anyway.
The court.battle is expected to last several weeks.

cations for garbage can be found.

engineers fear that cstimatc-may be

A report from B.M. Ross and As-
sociates Consulting Engineers prc-
