Six neighbours of the Barnim development of the former
Seaforth Public School property are appealing the zoning
bylaw. amendment to the Ontario Municipal Board.
Huron East council received letters at its Jan. 20 meet-
ing announcing the neighbours' intention to appeal the
zoning amendment to the OMB and responded with a
resolution acknowledging the appeals but continuing its -
support of the amendment.
"We -need a resolution saying if you still want to pro-
ceed or if you've changed your... mind. You could, rest nd
the bylaw and you could be sued by the developer. You'd
need a good justification," said Clerk -Administrator Jack
McLachlan.
Thckersniith Coun. Larry McGrath said hewas con-
cerned that the third and final reading was done by coun-
cil with the engineering being completed, a concern that
was also raised in some of the neighbours' letters.
But, - Deputy -Mayor Bernie MacLellan reminded
McGrath that developer Brian Barnim -had told council
.he didn't want to : spend the money on- engineering if he
wasn't sure of council's support with the. zoning amend
ment.
Seaforth Coun. Joe Stefer advised council.to pass the
resolution supporting sting the zoning amendment so the ap-
f peals processcould begin.
"Let's get on with life. In today's economic times, we
need development so let the appeals be . heard and at the
end of the day, we'll abide by the appeal," he said.
Concerns raised in the neighbours' letters include the
lack of a -second access to the subdivision off of Goderich
Street, the lack of any parkland in the development and -
the density, of the housing allowed under the rezoning.
A letter from Don and Kathy Pletsch expresses concern
about the 32 buildings which could range from single de-
tached to quadplex impacting the storm sewers and sani-
taryy sewers. k;;. �_.{;. .
"We have not been shown even a draft plan of the systems
that will be required," said the letter.
The Pletsch letter also addresses no* access to Goderich
Street with the concern that all the traffic will empty onto
Market and Sparling Streets, asking if a traffic study has
been done.
"The street (Sparling) is 68 feet wide, eight feet less than
the standard width of 62," said the letter...
The Pletsches also express .concern about Huron East
council contributing $125,000 towards the construction of
Robert Street in the development with the condition that
the existing school building be torn doh .and removed
within one year.
"This is almost two years ago and the rubble from the
- school building remains. Hopefully, .because the condition
has been unmet, the town will be able to rescind this mo-
