to defy OCWA to prevent floods

Public works superintendent John Forrest is
ready to break the law if it means helping prevent
another flood in Seaforth.
"I'll accept the -consequences later," said Forest
at council's Sept. 12 meeting where a discussion
occurred about the town's flooding problems and a
lack of an easy solution to fix them.
Since this spring's flooding, Forrest had put his
telephone,number on the alarm system at the pump
house so if the pump went down, he would be
made aware and could try to fix the problem. )
However, he recently had to take his name off
the pumps because Ontario Clean Water Agency
staff are the only ones allowed to touch the
equipment despite it being a town -owned pump
house.
While Forrest can 1# at the pump house in
minutes during a flood. Administrator Jack
McLachlan said OCWA has four hours to respond
to an alarm.
Forrest said there are people in the
neighbourhood of the pump house that know to
call him if there is a problem at the pump house
and that he would respond anyone and face the
fines from OCWA for getting involved.
Town staff have been investigating ways to
reduce the impact of flooding after two floods
filled basements with water and sewage this spring
after heavy rains.
In 1991, Forrest said engineers told the town it
would be best to build a larger sewage treatment
plant rather than repair existing Teaks in the sewage
lines that allow groundwater to get inside that
contributed to some of the flooding in basements
this year.

19th day of September. 2000, under Section 38 (1) of the Planning Act, R.S.O. 1990, as amended.
AND TAKE NOTICE that any person oragency may appeal to the Ontario Municipal Board in respect of
the by-law by filing with the Clerk oft the Township of Tuckersmith, not later than the 18th day of
-November;-2000;-anotice-of-appeal-setting out the.objecuon_lo the by_iaw_and the reasons in support of the
objection, accompanied by payment of the fee prescribed under the Ontario Municipal Board Act.
AMOUNT OF FEE payable on appeal is $125.00.
Only individuals. corporations] and public bodies may appeal an interim control by-law 'to the Ontario
Municipal Board. A notice of appeal may not be filed on behalf of an unincorporated association or group.
However arnotice of appeal may be filed in the dame of an individual who js a member of the association or

CORPORATION OF THE TOWNSHIP OF TUCKERSMITH
BY-LAW NO. 116-2000
Purpose and Effect:
This by-law prohibits:
- the establishment of a livestock facility. building or operation. including manure storage facilities,
with a capacity of 250 livestock units'or greater. or any building if the owner docs not own or have
registered agreements of one acre per animal unit, where such liveitock operation involves.
requires or is designed for a liquid manure system; or
- the expansion of a existing livestock facility, building or operation. including manure storage
facilities. with a total capacity. after expansion. of 250 livestock, units or greater, or any building if
the owner docs not own or have registered agreements of one acre per animal unit, where such
livestock operation involves, requires or is designed for a liquid manure system.
The by=law is in effect for one year from the date of its passing. The Council may, by by-law, extend
the period of time during which the by-law will be in effect, provided that:the total period of time does not
exceed two years.
As a general prohibition. this By-law applies to all lands in the Township of Tuckersmith.
CORPORATION OF THE TOWNSHIP OF TUCKERSMITH
INTERIM CONTROL BYLAW NO. 16-2000
WHEREAS the Municipal Council of the Corporation of the Township of Tuckersmith, pursuant to
Section 38 (1) of the Planning Act, RSO. 1990, as amended, has passed a resolution directing that a review
or study be undertaken in respect of land use planning policies regarding intensive livestock operations;
AND WHEREAS Section 38 of the Planning Act, RSO 1990, as amended, allows for the passing of an
interim Control By-law prohibiting the use of land. buildings or structures within the municipality for. or
except for, such purposes as are set out in the By-law;
NOW. THEREFORE. the Council of the Corporation of the Township of Tuckersmith ENACTS AS
FOLLOWS:
1. No land, building or structure in the Township of Tucketsmith. including land in the General
Agriculture (AGI) Zone -and Restricted Agriculture (AG2) Zone as shown in Zoning By-law No. 38-1985,
as amended, 'shall be used for the following uses:
- the establishment of a new livestock facility, building or operation, including manure storage
facilities. with a capacity of 250 livestock units or greater. or any building if the owner does not
own or have registered agreements of one acre per animal unit, where such livestock operation
involves, requires or is designed for a liquid manure; or
the expansion of a existing livestock facility, building or operation. including manure storage
facilities, with a total capacity, after expansion, of 250 livestock units or greater. or any building if
the owner does not own or have registered agreements of one acre ,per animal unit, where such
livestock operation involves. requires or is designed fot a liquid manure system.
2: This by-law shall be in effect for a period of one year from the date of passing of this by-law. or until
repealed.
3. This by-law shall come into force pursuant to Section 38 of the Planning Act, RSO 1990, as amended.

Now, the engineers are recommending the .lines
be repaired as a solution to the flooding.
But it wasn't the answer the town had been
hoping for since repairs to the sewage lines would
he long-term and costly and wouldn't prevent
another flood from occuring if there was another
heavy rain.
However, the town has taken some steps to help
reduce the problem.
For example. Silver Creek has been cleaned out
to help it handle the runoff which overflowed the
creek this spring and contributed to street flooding:
Flooded streets then filled the sewers through
manhole covers. adding to the problem with
flooded basements when sewers backed up.
"Hopefully we've taken enough preventable
measures that we can handle this now," said
Forrest.
OPP recover stolen van
Huron OPP recovered a stolen van with a motorcycle
inside on Sept. 21 in Egmondville.
An officer on patrol discovered the van abandoned at
the dead end of Second Avenue. It's windows had been
smashed out and the ignition area of the 1994 Plymouth
van had been damaged.
OPP learned the van had been stolen from London
earlier that day.
However, the motorcycle, a red and white Honda 250,
did not belong to the owner of the van and OPP have not
determined who its owner is.
