Cooperation of defense,

spared Seaforth man from
jail time for assault
A Seaforth man who was
found guilty of assaulting his
former wife would have
received jail time if it were
not for the deal reached by
the defense, the prosecution
and the victim. said the pre-
siding judge.
Accepting a joint suhrnis-
sion, Judge N Douglas lined
41 -year-old Richard S Hulley
$200 and issued a two-year
probation order during which
Hulley may only contact his
former wife to arrange access
to their children and has to
take any recommended coun-
selling.
That submission and a
guilty plea to an assault,
yihich.Dauglas called "not as
serious" as others on a scale
of assaults, spared Hulley
from going to jail, said
Douglas.
Crown Robert Morris said,
Hulley's former wife was not
injured after Hulley shoved
her by placing his hand under
her chin on June 6. Wiley
had asked their son to tell her
to come to his Goderich
Township cottage. Once she
arrived at the cottage, Hulley
questioned her about missing
items, then he stepped onto
the porch and shoved her.
Douglas said the facts of
this case arc frustrating
because Hulley was still on
probation for assaulting the
• same woman two years ago
when the June 6 incident
Occurred.

Seaforth man
fined $400
for careless
storage
A 42 -year-old Seaforth
man was fined $400 for the
careless storage of a firearm
after his •son accidentally dis-
charged the weapon in the
street outside his home.
John M. Nash pleaded
guilty to the charge.
Court was told the 12 -
gauge shotgun was locked in
the trunk of Nash's car in a
soft. zipper cover. The gun
did not have a trigger lock
and. after using it for target
practice. Nash did not realize
the gun was still loaded with
bird shot.
Without permission, his
12 -year-old son had gone to
the trunk. As he was lifting it
out, the gun went off with the'
shot striking the rear window
of a parked vehicle across the
street.
Defence lawyer Phil
Cornish said Nash was inside
his apartrnent and noticed his
son going to the car. He
yelled at him hut his son did
not hear. By the time Nash
was on his way to the car, the
gun had gone off.
Cornish said the gun was
secured to a degree and asked
Judge RG Hunter to consider
a suspended sentence.
But Hunter said this is
ample proof why there are
regulations for storing the
weapons and that there had
been ammunition inside.
Cornish said Nash wasn't
aware the gun was loaded.
"That makes it even
worse," Hunter said.
Cornish still pursued an
easier penalty for Nash say-
ing it would he unfortunate
that a moment's carelessness
would give Nash a criminal
record.
"It could have cost some-
body his life," Hunter said,
adding he had already issued
another man a fine that day
for careless storage. In that
case, the weapons did not
have ammunition in them and
were antiques.
"This is a more serious
incident," he said, issuing a
$400 fine and giving Nash
one month to pay it.
