BY-LAW NO. 244996
BEING a By-law to) establish an interim control area in the Township of
Hibbert with respect to the establishment of new rural residential uses
WHEREAS the Council of the Corporation of the Township of Hibbert has
passed a resolution directing that a study be undertaken regarding land use
planning policies in the Township.
ANI) WHEREAS pursuant to the provisions of Section 38 of the Planning
Act, R.S O 1990. by laws referred to as Interim Control By-laws may he
passed by Councils of municipalities for prohibiting the use of land,
buildings. or structures within the municipality or within specific areas
defined in such by-laws. .
NOW THEREFORE: the Council of the Corporation of the Township of
Hibbert enacts as follows:
L That all lands within the "Agricultural Zone One (A 1 )" and the
"Agricultural Zone Two 1A2)" in the Township of Hibbert Zoning By-law
No. 23-1986 he designated as an interum control area in which
(i) no new rural residential uses shall he permitted to be established in the
"Agncultural Zone (inc (AI)'- and the "Agncultural. Zone Two (A2)"
, zone classificatidns in the Township of Hibben -
2. The prosisions of Section 1 above shall be in effect for a period of one
year from the date of passing of this By-law.
3 This By-law shall curve into effect Oil the final passing thereof by the
Council of the Corporation of the Township of Hibben pursuant to the
provisions of Section 38 of the Planning Act, R.S 0 1990

TAKE NOTICE that the Council of the Township of Hibbert passed By-law
No. 24-1996 on the 4th day of November, 1996 under Section 38 of the
Planning 'Act. R S.O., 1990.
ANi) TAKE NOTICE that any person or agency may appeal to the Ontario
Municipal Board in respecl'id the Bylaw by filing with the Clerk of the
Township of Hibben not later than the 3rd day of January, 1997 a notice of
appeal setting out the objection to the By-law and the reasons in support of
Lir objection
An explanation of the purpose and effect of the By-law, descnhing the lands
to which the By-law' applies is attached. The complete By-law is available for
-inspection in my office dunng regular office hours.

EXPLANATORY NOTE FOR BY-LAW NO. 24-1996
By-law No: 24-1996 is an Interum Control By-law which was passed by
Township Council pursuant to the provisions of Section 38 of the Planning
Act. R S.O. 1990. The By-law establishes all of the land in the Township
which is within the "Agncultural Zone One (Alt" and the "Agncultural Zone
Two (A2)" of the Township's Zoning Bylaw No. 23-1986 as an interim
control area in which.
(i) no new rural residential uses shall be permitted to be established in the
"Agricultural Zone One (AI)" and the "Agricultural Zone Two (A2) -
zone classifications in the Township of Hibbert. •
The By-law has been adopted to give Council time to.
1. undertake a study to investigate the appropriateness of continuing to
permit the development of new rural residential uses in the agncultural
areas of the Township: and.
2. to prepare any necessary revisions to the Township's planning documents
to implement Council's findings.
By-law No. 24-1996 shall be in effect for a penod of one year from the date
of passing.
Pursuant to the provisions of Section 38(2) of the Planning Act, R S 0 1990.
Township Council has the authority to amend By-law No. 24-1996 to extend
the period during which the By-law will be in effect to a total penod not
exceeding Iwo years from the date of passing of By-law No. 24-1996.
