Man gets jail for assault with a baseball bat An RR1, Holyrood man was sent to jail after pleading guilty in Wingham's provincial court. Oct. 16 to assault with a weapon. Crown Attorney Bob Morris said an assault was reported to Wingham police on Jan. 20. When they arrived they found the victim bleeding from the left side of his head. He was treated at the hospital and later released. Morris said a witness stated that Joe Hodgkin had “come at them with a bat”. Defense counsel Mr. McEachran said that his 33-year-old client had been going through some personal problems prior to the incident. He make a joint submission for a sentence in the range of 90 days to be served intermittently. Judge R.G.E. Hunter questioned counsel on why the assault occurred. “What was this all about?” McEachran said he had had no definitive answer on that, but noted there appeared to have been a number of people involved. Asked for an explanation Hodgkin said it began with an “overheated argument. I was tired of it.” McEachran also indicated that there had been a fight between a friend of Hodgkin and another individual and that at least one other person had a weapon. The arresting officer’s notes stated that a knife had been found, counsel said. “The witnesses all seemed reluctant to go into details. The victim did not say who hit him.” Hunter sentenced him to 90 days to be served intermittently. He was placed on two years probation, a condition of which is that he receive counselling. Hodgkin is prohibited from owning weapons for 10 years and had to provide a DNA sample. Impaired A Wroxeter man pled guilty to impaired driving and refusing to provide a breath sample. Morris said that Theodore Thompson was arrested Aug. 9. Wingham police had been advised by OPP officers to watch for Thompson’s vehicle. It was located in a parking lot. Thompson was eating pizza and the keys were in the ignition, said Morris. Detecting an odour of alcohol and noting signs of impairment, officers arrested Thompson. Morris said that while in custody, the accused shouted threats and refused to provide a breath sample. Duty Counsel John Schenk said that since the arrest, Thompson had entered into a counselling program for substance abuse and anger management. He also entered into an undertaking with Wingham police to not possess any firearms for a year, “even though he makes his living that way.” said Schenk. Noting previous charges for impaired and refusing to provide a sample from 1993 as well as a 1999 conviction for driving with over 80 mg of alcohol in 100 ml of blood. Hunter said Thompson would be looking at more than the minimum sentence of 14 days. The accused was given 45 days on each charge concurrent, plus is off the road for two years. Thieves take On Oct. 19 at 3:15 p.m. OPP were called to a residence on London Road in Morris-Turnberry over the theft of riding lawn mowers. The victim told police that sometime during the evening of Oct. 17 and 18 between 9:30 p.m. and 12:30 a.m. a person entered his laneway and stole a red Roper Model YT110DT riding lawn mower. Break and enter A pre-sentence report is being prepared for Branden Morden of Clinton who pled guilty to break enter and theft and failing to stop for a police officer and careless driving resulting in bodily harm. Morris said Morden was involved in a break-in at a gas bar north of Wingham. The accused spraypainted the video camera and helped to carry items out of the business. Police arrived on the scene to see a white truck race away. As the cruiser lights were activated the truck’s speed increased. After a 3.5 km distance, the truck went off the road and rolled. One of the individuals with Morden received face and head injuries, while a second had facial cuts and nerve damage. Morden will be sentenced Nov. 20. Uttering a threat William Versteeg of RR5, Wingham was charged Aug. 5 with uttering a threat. Police were called to a residence by the victim who wanted to turn in a rifle. She said she was afraid to have it in the house, as Versteeg had threatened her that day. Versteeg who pled guilty has no record. Hunter agreed to a joint submission of a suspended sentence and 12 months probation. Versteeg is to have no contact with the victim and must receive counselling as recommended. He is prohibited from owning weapons for five years. Assault An RR3, Brussels man pled guilty to assault. Morris said that during an argument on Sept. 30, the victim, a female, had punched Darwin Ducharme on the shoulder. “He responded by punching her in the eye.” She sustained a black eye, bruises and scratches. The 47-year-old accused has no record. He was given a suspended sentence and 12 months probation. He is prohibited from owning weapons for five years. Assault Steven Porter, RR5, Lucknow, was charged Aug. 29 with assault. He pled guilty to the charge. Morris said the accused got into an argument with the victim, during which he grabbed her, pushed her and prevented her from using the telephone. Schenk said the 27-year-old, who has no related record, admitted that what he did was wrong. He too was given a suspended sentence and one year probation. There is also a five-year weapon prohibition. Mischief Charles Mason of Etobicoke pled guilty to mischief under $5,000. Morris said Mason became upset over a personal situation and kicked in a screen door. He also ripped some trim off a porch and tore a canopy. Damage was estimated at $100 and restitution has been made. Mason received a suspended sentence and 12 months proba­ tion. mowers The owner also said a similar thing happened earlier that year when a red 8 HP Massey Ferguson riding lawn mower was stolen from the driveway.
