Court news
A Brussels man was sentenced to
60 days in jail after trying to defend
himself in Wingham's provincial
court, Oct. 21. against a charge of
dangerous driving.
OPP Const. Lorne MacIsaac
testified that he and Const. Mark
Fraser had been patrolling in
Brussels, June 8, when they saw the
accused. Mike Cooper, leaving his
home. MacIsaac said they watched
Cooper walk towards the driver's side
of a car, the keys in his hand.
The officer said the accused then
saw the police. "He walked back to
the house smiling and waved at us."
Maclsaac said some time. later, he
and Fraser met the car coming
towards them, driven by Cooper,
whose licence had been suspended
He testified that they followed him
and saw him go through two stop
signs. the second on the right side of
the sign, across a lawn to "cut the
corner."
After losing sight of the vehicle,
they followed tracks, that often
crossed lawns, until they turned west
towards Cranbrook.
He also explained that no attempt
was made to stop the accused as they
identified the driver so pursuit wasn't
necessary.
MacIsaac said there was not a lot of
traffic on the streets at the time.
"However," he added, "this is a
residential area, and there was no
indication of brakes, but I did see
acceleration."
In his defense, the 23-year-old
Cooper said he had been in the car,
but was not driving. Asked why the
car accelerated, he explained that the
driver also did not have a licence and
they didn't want to get stopped. He
admitted that his friend had been
driving very fast.
"Did you not know he was driving
dangerously," said Attorney for the
Crown Rod Guthrie.
"Of course I knew [it] was driving
dangerously. I'm not retarded," said
Cooper.
F.E. Madill
students
get awards
There was much to celebrate in
Wingham on Oct. 22 as local
graduates of F.E. Madill Secondary
School were among those to receive
awards at the commencement
'ceremonies.
Josie MacDonald recieved the
drama award and was the recipient
of the Blyth Festival scholarship for
being involved in drama projects at
the school and proceeding to a post-
secondary theatrical program. She
was also presented with the
Teachers - Festival Liaison Council
scholarship for making an
exemplary contribution to the drama
projects at the high school.
The French award was presented
to Alicia Marshall as was the Beulah
Mason, Memorial award donated by
the registered nurses of Wingham
and District Hospital, for
involvement in volunteer work and
continuing her education to become
a registered nurse. She also received
the student trustee award.
Luke Beyersbergen was the
recipient of the West Wawanosh
Mutual Insurance award for
furthering his education in
agriculture or in a related field. He,
along with Matthew Hanna, was
also recipients of the transportation
technology award.
Kyle Stephenson was awarded the
Brussels Community Development
Trust scholarship for being a
graduate from Brussels Public School

were tinted, he suggested that it
would be impossible for the officer to
identify him as the driver.
Judge R.G.E. Hunter begged to
differ, however, saying he accepted
the officer's evidence.
In addition to his jail time, Cooper
is off the road for another 12 months.
Unpaid fines
Hendri kus Vanden Brink of
Fordwich, was sent to jail for not
having paid $3,010 in fines.
The first fine of $1,000 was for a
breach of probation conviction on
July 15, 2002, while the second of
$2,000 was from Sept. 23, 2002 for
impaired and breach. There was a $5
surcharge on each.

Impaired
Scott Clarkson of Brussels pled
guilty to impaired driving.
On Feb. 13 at 11:18 p.m. police in
Brussels pursued a car that went
through several stop signs before the
driver turned into his apartment
parking lot and ran from his car.
When they caught him, officers noted
signs of impairment.
_ Breathalizer.readings were 100 mg
of alcohol in 100 ml of blood.
Clarkson was fined $750 and is off
the road for 12 months. He has 90
days to pay the line.
Care and Control
Michael F. Nilsson of Wingham
entered a guilty plea on a charge of
having care and control of a vehicle
while having over 80 mg of alcohol in
100 ml of blood in his system.
March 13, police in Wingham came
upon a car stuck in a snowbank.
Nilsson was in the driver's seat and
the engine was running. Guthrie said
a friend was outside trying to get the
car free of the bank.
Officers detected an odour of
alcohol on Nilsson. Breathalizer
readings were 160 mg of alcohol in
100 ml of blood.
Duty counsel Lynn Johnston said
the 33-year-old was taking a friend
home and admits he "exercised bad
judgement" in doing so.
He was fined $750 and had his
licence suspended for one year. The
judge gave him six. months to pay the
fine.
Pre-sentence reports
Pre-sentence reports are being
prepared for two women charged with
separate crimes.
Jacquie Waechter of Brussels pled
guilty to defrauding the Ministry of
Community and Social Services from
Aug. 19, 1998 to June 31, 2000. The
total value was $20,748.23.
Donna Middelkamp of Blyth
entered a guilty plea to usidg a forged
document between the dates of June
11 and July 27. The value is $9,600.
Both women will appear in the
November court for the facts of the
case to be presented and to be
sentenced.
