Court news
Judge sentences man to 5 months in jail
A Brussels man is spending live
months in jail after pleading guilty to
a charge of possession of burglary
tools and two charges of breaching
probation.
Michael Walker was arrested July
24 in Hensall.
Attorney for the Crown Rod
Guthrie said at 12:20 a.m. police
received a call about two men who
had gotten out of a truck in the
parking lot of the LCBO.
Police arrived within minutes and
found in the truck a pry bar,
hacksaw, flashlight and cutters. The
OPP canine unit was called and
Walker and the co-accused were
found hiding in the cornfield.
"It was clear that they were jointly
in possession of the items." said
Guthrie.
Regarding the probation charge,
Guthrie stated that Walker had failed
to carry out the important terms of
the order. "He never showed up. he
never did anything."
Walker's defence counsel
explained the breach offense saying
her client had had some contact with
the probation officer, but "did wit
want to take the Ritalin", which he
knew would be a condition.
However. she said that prior to this
incident. Walker had been "doing
really well" and "hopes now to make
it a longer stretch."
Judge R.G.E. Hunter imposed a
sentence of three months for the
possession charge and one month on
each count of breach to be served
consecutively. Upon release Walker
will be on 18 months probation.
Assault
Matthew Cameron of Atwood pled
guilty to assault.
According to Guthrie, the accused
had visited the victim's home at 9:30
p.m.. Jan. 2 and after a brief
conversation punched him in the
face with a closed fist. The victim
sustained a swollen lip and loosened
tooth.
Defence counsel Lynn Johnston
described her client as someone who
had a drug problem. but who has
now taken steps "to get his life
together."
Cameron, she said, has received
treatment for drug use and has also
contacted an organization regarding
anger management counselling.
Taking into account two previous
convictions for assault in July 2002,
Hunter sentenced Cameron to 90
days to be served intermittently. He
was also placed on probation for 18
months and is prohibited from
owning firearms for five years.
Jailed
A Kitchener man faced charges of
break, enter and theft, as well as
failing to appear in court.
Robert John Evens, pled guilty
earlier to a break, enter and theft at
Snyder's in Wingham, in December
2002, but failed to keep his court
date for facts and sentencing. He
later turned himself in.
The other thefts occurred in the
same time period at Edge Market in
Wingham, Sticker's Restaurant in
Auburn and the Belgrave Variety. In
each case entry was gained by
breaking a window. He pled guilty to
these charges. and the fail to appear
charge, Thursday.
Regarding the Snyder's break-in,
Evens told police that his co-
accuseds had broken the window
and loaded things into the bag.
However, many of the stolen items
were found at the Evens's apartment.
Guthrie said the value of what was
taken from the latter three businesses
was difficult to determine as it was
mostly small items such as candy.
However, the owner of Snyder's was
out $500 deductible and the
insurance company had paid
$1,822.84.
Evens's defence counsel said his
client had given him $800 to be used
towards restitution. He also noted
that his client has taken steps to
reform himself and has distanced
himself from his co-accuseds.
Hunter sentenced Evens to 90 days
concurrent on each charge. He owes
a remaining balance of $611 on his
third of the restitution for the
insurance premium. He has six
months to pay.
Evens is also on probation for two
years.
Over 80
A Brussels man pled guilty to
driving with over 80 mg of alcohol
in 100 ml of blood.
Guthrie said on Sept. 13 police
stopped Lee Dilworth to check
documents and speak to him about
the volume • of his car stereo.
Smelling an odour of alcohol the
officer gave him a roadside test
which Dilworth failed.
Breathalizer readings were 120 mg
of alcohol in 100 ml cif blood.
Defence counsel Glen Carey drew
attention to his client's "relativly low
reading" and the fact that there had
been no "bad driving".
"He thought he was okay. unlike
the friend he was transporting."
He was fined $750 and is off the
road for one year. Hunter gave' him
30 days to pay the fine.
Mischief
Timothy Michael Cook of
Wingham pled guilty to committing
mischief under $5,000 and
breaching a probation order.
Guthrie said that police were
called to a residence on Feb. 1
regarding someone trying to gain
entry into an apartment. and as a
result damaging the door. Cook, he
stated, had found out about a "sexual
assault" allegedly committed by the
complainant and went to his
apartment to "tune him in."
Hunter fined Cook $300 on each
count and placed him on 12 months
probation. He has four months to
pay the fine and is on probation for
12 months.
Possession of stolen property
John Topor of the Belfast area pled
guilty to possessing stolen property
and a breach of probation.
Guthrie said that on Jan. 20 police
in Wingham noticed footprints
travelling in and out of several
driveways. They came upon the
accused and another individual and
during a search recovered .a number
of items which it was later learned
Break-in
at HE
residence
On June 9 at 5:15 p.m.. OPP were
called to a break-in on Livingston
Line in Huron East located between
Walton and Monkton.
The officer found that sometime
that day between 7 a.m. and 5 p.m. a
person forced open a door to the
residence. Once inside, the home
was ransacked and $2,000 worth of
property was stolen: Taken was a
27" Toshiba TV, a tackle box full of
lures, a Sony camcorder, cigarettes
and a case of pop.

Fraud
Hunter suspended passing of
sentence for an RR1, Bayfield
woman who pled guilty to charges of
using a forged document.
Guthrie said police were called by
the bank regarding two cheques
which they believed had forged
endorsements. Debbie Malone was
arrested Sept. 2.
Duty counsel John Myers said that
at the time of the incident Malone
and her family were in a financial
crisis, that she regretted what she
had done hut had done it out of
desperation.
Hunter placed her on 12 months
probation with a stern warning. "If
this happens again you're going to
jail."
Assault
A man who pled guilty to charges
of assault has been given an
opportunity to get his life turned
around.
Joel Hill, currently of Goderich
was charged Aug. 31. Guthrie said
Hill was very intoxicated at the time
and pointed out a history that
"reflects a problem with alcohol".
Myers said that Hill is remorseful,
has completed a treatment program
and is heading in a positive
directions. He has not- had a drink
since April 12.
' Hunter suspended passing of
sentence and placed him on two
years probation. "You will not
purchase, possess or consume
alcohol for two years. You breach on
that you're not going to get
sympathy from me."
Hill is also prohibited from
owning firearms for five years.
Mischief
A concerned father ended up in
court to answer to a charge of
mischief.
Glen Rodda of Marnoch Line
admitted to damaging the aerial on a
car at his property. He believed that
an acquaintance of his son, a person
of whom he did not approve, was the
driver of the car.
He was given a conditional
discharged and one week to make
restitution in the amount of $100. He
was placed on probation for three
months.
