County hires lawyer for OMB fight

Huron County councillors have
authorized the hiring of a lawyer to
defend the county's decision to turn
down a zoning change that is now
being appealed to the Ontario
Municipal Board.
Council was informed at its April
I meeting that Gordon Lobb of
Woodland Links Golf Course, west
of Clinton, was appealing the
council's decision not to approve a
zoning change that would have
allowed him to expand the golf
course from 18 to 27 holes.
At the January meeting council
voted council voted 9-7 to support
the decision of the health and
planning committee to turn down the
zoning request on the basis that too
many neighbouring farms might be
adversely affected if they needed to
expand in future. The county's
planning department and the
Municipality of Central Huron had
supported the zoning change.
Rob Morley, councillor for South
Huron worried that the county might
be spending money on a hearing it
can't win since council voted against
its own planning department
recommendation.
"I don't want to spend a lot of
money if we don't stand a chance of
winning," Morley said.
Planning director Scott Tousaw
advised council to hire legal advice.
"It would be prudent to have
representation to avoid costs," he
said. Though he didn't see a real
possibility that the county could get
stuck paying the legal costs for other
parties at the hearing if it should
lose, "Legal motions could be
, brought by counsels for other parties
if you don't have anyone there to
represent you," he said.
On questioning by past. warden
Dave Urlin, Tousaw said he didn't
know how long a municipal board
hearing on this case might last but
the estimate for another appeal of the
expansion of the Bluewater Golf
Course at Bayfield is seven weeks.
Since legal fees are typically $500 to
$1000 a day. costs can mount.
John Bezaire, councillor for
Central Huron wondered who
decided how often the county's
lawyer would have to be in the
hearing.
"We haven't had appeals of this
magnitude before," Tousaw said.
"It's a decision for the client and the
lawyer. My guess is that a lawyer
would feel its best to be there every
day to hear the proceedings.
Bezaire wondered if the county
should be looking at getting
independent planning advice too.
"We're going into this without the
support of our own planning
department," he said.
Hearing the doubts expressed by
his colleagues, Bluewater councillor
Paul Klopp argued that there were
reasons councillors had turned down
the application. "We can't just look
at the cost (of the OMB hearing)."
The county's regular legal
advisers, Donnelly and Murphy will
likely be representing Central Huron
so the county must get different
counsel. The lawyer will meet with
council before proceeding further.
