A -Brussels man was sentenced to
jail after pleading guilty to four
charges in Wingham's provincial
court, March 18.
Albert Dale Ruby pled to assault
causing bodily harm, assault, and
two charges of breaching a court
order.
Attorney for the Crown Brian
Linley said that on Nov. 27 a fight
broke out at a residence between the
accused and the female victim. As
the confrontation escalated, the
victim's thumb was broken. She
eventually gOt away and called
police.
Police were also told that between
Oct. 15 and Oct. 31 another assault
had occured, this time on a 13-year-
old child. According to Linley, Dale
had become angry at the way the
child was behaving. He stepped on
her foot and grabbed her hair.
Defense counsel Tim Macdonald
said that with regards to the assault
causing bodily harm, it was more a
result than the nature of the assault.
"He had not been looking to cause
the brokeifthumb."
Also, he indicated that in the case
of the assault charge the child had
been aggressive and extemely
disrespectful. "But, he overreacted."
Released on bail after the arrests,
Dale was in breach of the
conditions, Dec. 29 when he
appeared at the victim's residence to
drop off Christmas presents, said
Macdonald.
Another condition was that Dale
_reside with his mother. However,
Macdonald said the two had a
disagreement and he moved out,
March 12.
He noted that after the second
breach, the 35-year-old had turned
himself in and had been in custody
since March 13.
Macdonald said Dale wanted
counselling and while his record
spans from 1988 to 1993 there were
no violence-related convictions.
Judge R.G.E. Hunter imposed a
90-day sentence for the assault
causing bodily harm, 30 days
concurrent for the assault and 10
days concurrent on each charge of
breaching a court order for a total of
90 days. This is to be served on
weekends.
Dale is also on 12 months
probation. He must provide a sample
of DNA and is prohibited from
owning weapons for five years.
Assault
A report will be presented in June
prior to sentencing of an RR2,
Seaforth man.
Joel Hill pled guilty to two counts
of assault, which occurred Feb. 11
and to breaching probation ordered
Nov. 20. Facts will be presented at
the June 17 court.
Assault
Mark Thomas Cook pled guilty to
a Feb. 29 assault in North Huron.
Police attended a residence March
1 in response to a call about an
"unwanted" person. The victim said
the accused had left and was waiting
for a bus. She said that on the
previous night Cook had pushed her
against the door with his arm against
her neck. "She feared for her safety,"
said Linley.
Cook has no similar record.
He was given a conditional
discharge and placed on 12 months
probation. He is also prohibited
from owning firearms for five years.
Breach
Trevor Huffman of Kitchener was
arrested March 2 for breaching
probation in Wingham.
Glen Carey, counsel for the
accused said Huffman, who pled
guilty, had "squared off in a
consensual fistfight."
The probation order was from
Dec. 12, 2002 and Carey noted that
Huffman "did have, save and except
this night, positive response to the
probation order."
Hunter fined him $400. He was
given six months to pay.
Fraud
Sentencing will be next month for
a Wingham man who pled guilty to
breaching probation and fraud.
Linley said that William Coates
was placed on probation June 27.
One of the conditions was that he
abstain from alcohol.
At 9 p.m. Oct. 27 an officer heard
noise behind a downtown business.
He found two intoxicated males, one
of them Coates.
Also that day police received a
complaint from the parent of a
special needs child. His daughter, he
said, had been at the bank with
Coates.
The accused got her pin number
and deposited an - empty envelope,
then withdrew $100.
Duty counsel George McKinley
said Coates had not kept the money
but gave it to the victim. The fraud,
he explained, was therefore against
the bank.
When Coates indicated he
expected to make restitution in a
week, Hunter postponed sentencing
for the April 29 court.
His record showed five previous
convictions.

Gas stolen from
cars in Ethel
On March 17 at 8:45 a.m. OPP that another neighbour had gas
were contacted by a citizen who said stolen from his vehicle.
gas was being stolen from vehicles
in a driveway on Ethel Line in
Huron East. Two vehicles, 1989
Dodge and 2000 Dodge vans had the
gas caps removed and a small
quantity of gas siphoned from them.
The owner also found that the same
people had entered two unlocked
sheds. Further checking also found
