Dairy farmer to serve time on weekends
An RR1, Bluevale man has been
sentenced to jail for crimes that date
back almost a year.
Asa Hoover pled guilty in
Wingham’s provincial court May 15,
to charges of car theft, mischief
under $5,000 and driving while
disqualified.
Crown Attorney Bob Morris said
that on June 22 Hoover had taken a
van from a driveway in Brussels. He
then took the van to Ethel where it
struck a mailbox. Damage to the
vehicle was estimated at $2,000 to
$3,000.
After his arrest it was learned that
he was serving a two-year driving
prohibition.
Duty Counsel John Myers said
that the 19-year-old was willing to
make restitution. He also said that
Hoover was now working full-time
on a dairy farm and had animals of
his own which required day-to-day
care. “The incidents were a year ago
and it would seem he’s turned a
comer.”
He asked that if a sentence was to
be imposed it be served
intermittently.
Judge R.G.E. Hunter sentenced
Hoover to 30 days for the theft, 30
days consecutive for driving while
prohibited and 15 consecutive for
the mischief. He is to make
restitution in the amount of $2,500
within one year.
Following his sentence Hoover
will serve 18 months probation.
Break and enter
A Wingham man pled guilty to
break, enter and mischief, causing a
public disturbance and failing to
comply with undertaking that he
abstain from alcohol consumption.
Morris said Wingham police were
called to a residence at 7:19 p.m. on
Oct. 20. They were told by the
victim that Dwight Chambers had
broken in the doors and caused
damage in the amount of $792.35.
Then on Dec. 8 police were
dispatched to a fight outside the bar
in Wingham at 1:25 a.m. Chambers
and another man were fighting and
police used pepper spray to separate
them.
After being taken into custody
police learned that Chambers was
bound by an undertaking to abstain
from the consumption of alcohol.
As his record was submitted,
defense counsel Mike Donnelly
noted that despite his client’s “long
history with the law”, things had
turned around since 1997.
“For the past seven years he has
been employed. He says he hardly
goes out on weekends and when he
does, he doesn’t look for trouble.”
Currently serving the remainder of
an eight-year-old sentence,
Chambers was sentenced to 60 days
concurrent for the break and enter.
Hunter fined him $400 for
disturbing the peace and $500 for
Carrick pleads guilty to manslaughter
The court ordeal is nearing a
conclusion for the family of 78-
year-old Harold McGee of Nile who
was murdered in late 2001.
The second defendant, Joseph
Bruce Carrick of Dungannon,
entered a not guilty plea to the
charge of second degree murder, but
guilty to manslaughter when he
appeared in Goderich court May
9.
The plea resulted in Carrick
waiving his right to trial by jury. He
will appear in court June 20 for a
pre-sentencing hearing. The
maximum sentence for
the breach. He was given six months
to pay restitution for the damage to
the doors and 12 months to pay the
fine.
Chambers is on probation for 12
months and can have no contact with
the victim.
Cause disturbance
The second man involved in a
fight which occurred in the early
morning hours of Dec. 8 outside a
bar in Wingham pled guilty to
causing a public disturbance.
Jordan Nixon of Wingham was
fighting with Dwight Chambers
when officers arrived. After the two
men were separated, Morris said,
Chambers’s brother jumped in and
he and Nixon exchanged more
punches.
Nixon was on probation at the
time.
Defense counsel Glen Carey said
since this time probation has expired
and his client has “turned a comer.
Nixon was fined $400 and was
placed on 12 months probation. He
was given 90 days to pay the fine.

The home invasion which resulted
in McGee’s death had been
suggested as a robbery by Carrick ,
said Crown Attorney Bob Morris,
because he had been in the home
previously with the victim’s son.
Morris said that while Carrick and
co-defendant Jason Brown, already
sentenced to life in prison, were
equally involved in the planning of
the robbery, murder had not been
part of that plan.
After entering the victim's home
and removing the phone from the
receiver, the two men went to

Russell David Ladouceur of
Brussels was arrested for driving
with over 80 mg of alcohol in 100 ml
of blood on March 15. He pled
guilty.
Morris said officers patrolling in
Brussels at 3:50 a.m. came upon a
car that had plowed into a
snowbank. The engine was running
and the front wheels were spinning.
Officers detected an odour of
alcohol on the driver and signs of
impairment.
Breathalizer readings were 210
mg of alcohol in 100 ml of blood.
The 18-year-old has no record.
He was fined $850 and is off the
road for one year. Ladouceur was
given 60 days to pay.
Mischief
Mike Cooper of Brussels entered a
guilty plea to a charge of mischief.
According to Morris, Cooper
approached an ex-girlfriend and an
argument followed. As she
attempted to drive away, Cooper
kicked the right-side door causing a
McGee's bedroom then discussed
what they should do, said Morris. It
was decided to strike him while he
slept.
Brown struck McGee with
a crowbar, causing his death.
Carrick made no attempt to stop the
attack, said Morris, but stood and
watched.
Carrick then searched the home
for money and property. Between
$1,200 and $2,000 in cash was
taken.
Items worn by Carrick during the
break-in as well as some of the
stolen items were later burned.

Assault
A Wingham woman was given a
suspended sentence and 12 months
probation for assault.
Roxanne Visser, who pled guilty,
was charged March 21 after police
were called to the hom^ of her ex-
husband in Bluevale. During an
aigument she ripped his shirt and
after grabbing a breadknife
threatened him.
Defense attorney Lynn Johnston
said her client had been receiving
counselling since the arrest. “She
went quickly to get help,” and took
“immediate steps to deal with the
problem so it never happens again.”
Her client, who has no record has
been “upset by the experience and is
sorry”.
Visser is also prohibited from
owning weapons for a period of five
years.
Carrick used his portion of the
stolen cash to purchase marijuana, a
cell phone, cell phone cards and
other drug paraphernalia, said
Morris.
