NOTICE OF APPLICATIONS FRANCHISE APPROVAL AND CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FOR THE TOWN OF WINGHAM,
TOWNSHIPS OF EAST WAWANOSH, MORRIS, GREY, TURNBERRY AND CULROSS AND THE VILLAGES OF BLYTH, BRUSSELS AND TEESWATER AND
LEAVE TO CONSTRUCT FOR THE TOWN OF WINGHAM, TOWNSHIPS OF GODERICH, HULLETT, EAST WAWANOSH, MORRIS, TURNBERRY AND
CULROSS AND THE VILLAGES OF BLYTH, BRUSSELS AND TEESWATER
Union Gas Limited ("Union") has filed nine Applications dated March 1, 1995
under sections 8 and 9 of the Municipal Franchises Act R.S.O. 1990 c. M.55 with
the Ontario Energy Board ("the Board") relating to the Town of Wingham,
Townships of Culross, East Wawanosh, Grey, Morris, and Turnberry and the
Villages of Blyth, Brussels and Teeswater ("the Franchise Applications"). For
each of the Towns, Townships or Villages, Union seeks:
III an order approving the terms and conditions of the By-law granting the
right to supply gas and construct and operate works to supply gas
n an order dispensing with the assent of the municipal electors to the
By-law
IN a certificate of public convenience and necessity to supply gas and
construct works to supply gas
In addition, Union has filed an Application dated March 1, 1995 under sections
46 and 48 of the Ontario Energy Board Act R.S.O. 1990, c. 0.13 with the Board for
leave to construct natural gas pipelines and ancillary facilities in the Town of
Wingham, Villages of Blyth and Brussels, Townships of Goderich, Hullett, East
Wawanosh, Morris and Turnberry, all in the County of Huron and in the Village of
Teeswater and the Township of Culross, both in the County of Bruce ("the leave
to construct application").
Both the Franchise Applications and the Leave to Construct Application will be
considered at a public hearing.
How to see Union's Pre-filed Evidence
Copies of Union's pre-filed evidence are available for inspection at the Board's
offices, at Union's Head Office, and at the Offices of the Clerk-Treasurer of the
Town of Wingham, Townships of Culross, East Wawanosh, Goderich, Grey,
Hullett, Morris and Turnberry, the Villages of Blyth, Brussels, and Teeswater, and
the Clerk of the County of Bruce and the Clerk-Administrator of the County of
Huron (addresses below).
How To Intervene
If you wish to intervene (i.e. actively participate) in the public hearing, you must
answer the Application within 14 days after this Notice is published. Your
response must be delivered, or mailed by registered mail, to the Board Secretary
and to Union at the addresses below. If you wish to participate in the French
language in the hearing, your response must state this. Your notice of
intervention must also state:
1. your name, address, telephone and fax numbers;
2. your interest in these matters;
3. your intention to appear and participate at the hearing; and
4. the issues you intend to address during the
proceedings.
Copies of Union's prefiled evidence will be sent by Union to those intervenors
who request it in their responses. All intervenors will receive notice of the time
and place of the hearing.
Intervenor Funding
You have the right as an intervenor to apply to the Board for advance intervenor
funding to assist you or your group to participate in the hearing. Intervenor
funding may be awarded only in relation to issues which affect a significant
segment of the public, and affect the public interest and not just private interests.
Any person seeking advance intervenor funding must file with the Board a
written notice containing a clear statement indicating that the person requires
intervenor funding. This notice must be delivered to the Board Secretary
together with your notice of intervention described above.
Following the Board's determination of intervenor status, application forms for
intervenor funding will be distributed by the Board Secretary to intervenors
seeking such funding. The applications will be required to address further
criteria set out in section 7 of the Intervenor Funding Project Act. All applications
for intervenor funding will be considered at a later date.
How to Comment
If you wish to comment on Union's Applications without becoming a formal
intervenor you may write a letter of comment to the Board Secretary clearly
stating your views and any relevant information. Copies of such letters will be
provided to Union and will become part of the public record in the proceeding.
Alternatively, you may write to the Board Secretary to advise that you prefer to
make your comments orally at the hearing, in which case you will be notified of
the time and place of the hearing. If you wish to comment in the French
language at the hearing, your letter must state this.

IF YOU DO NOT FILE AN ANSWER OR INDICATE TO THE BOARD SECRETARY
THAT YOU WISH TO INTERVENE OR COMMENT AT THE HEARING, THE BOARD
MAY PROCEED IN YOUR ABSENCE AND YOU WILL NOT BE ENTITLED TO ANY
FURTHER NOTICE OF THESE PROCEEDINGS.

Procedural orders, as to how these matters will proceed, may be issued by the
Board from time to time, and copies of any procedural orders will be sent to all
parties.
