Call 887-9499. tfn Man loses license A Blyth man was fined $850 and lost his license for 12 months after pleading guilty to a charge of impaired driving at Wingham's provincial court, Oct. 21. Crown Attorney Robert Morris told presiding judge R.G.E. Hunter the charge was laid against Murray Walsh after his car struck a hydro pole on Dinsley St. in Blyth early on the morning of Aug. 14. Mr. Moms said the witness who called the fire department said Mr. Walsh was staggering. The Fire Chief also told police Mr. Walsh appeared, in his estimation, to be impaired. Mr. Walsh was hospitalized for treatment of injuries following the accident. Man pleads guilty to assault A Brussels man escaped a jail term after pleading guilty in Wing­ ham's provincial court Oct. 21 to a charge of assault causing bodily harm, due in part to letters describ­ ing his character in a positive man­ ner. Mark Barbour, 22, was fined $500 and given 12 months proba­ tion by Judge R.G.E. Hunter. The incident occurred on May 24 at a party following the F.E. Madill Secondary School formal. Crown attorney Robert Morris told the court the victim, Chad Jones, and some friends had attempted to climb a wall when Mr. Barbour and some others threw bottles at the wall. Mr. Jones was angered and tried to entice Mr. Barbour into a fight. Mr. Morris said the accused refused several times until Mr. Jones called him by a derogatory name. He then slapped Mr. Jones on the back of the head. During the fight, Mr. Jones fell to the ground where, Mr. Morris said, he was punched at least six times to the face by Mr. Barbour. Mr. Jones suffered a fractured nasal bone and cheek bone and a possible fracture to the outer eye, Mr. Morris said. In requesting punishment, Mr . Morris noted it was a serious assault, but one the accused had not started. "The injuries were exces­ sive, but due to the other facts it falls on the fence as to whether the punishment should be monetary or jail," he told Judge Hunter. Defense attorney Richard Marchuk presented letters of refer­ ence from Mr. Barbour's employ­ ers, who said since he had worked there he "has matured into a reli­ able individual" and from Stuart Parker, a captain with the depart­ ment of National Defense, who had worked with Mr. Barbour in Cadets. He provided a brief description of Mr. Barbour's char­ acter and demeanor. There were also evaluations done by the Wingham OPP regarding Mr. Barbour's work during his term in a college law and security pro­ gram. "After Mr. Barbour slapped the victim on the back of the head, the victim then hit him in the jaw and he just got carried away," said Mr Marchuk. "My client takes this matter seriously and it is an act out of character for a young gentleman who's normally a responsible indi­ vidual." Judge Hunter agreed that while the injuries were serious and Mr. Barbour had angered Mr. Jones by throwing bottles, Mr. Barbour had not wanted to fight at first. Based on that fact, he said a jail term would be unreasonable.
