Judge orders men to make restitution to theft victim
Two young men were given 12
months probation and ordered to
make full restitution after pleading
guilty in Wingham’s provincial
court on March 27 to the break and
enter at Diesel Car Diner and
Brussels Variety last December.
Crown attorney Alan Mill told
Judge Hunter that on the night of
December 12, Barry Edward Cron
in, 21, of Mitchell and Gregory
Smith, 20, of RR 5, Seaforth had
realized they were out of cigarettes
so attempted to break in to the
business. For some reason, they
said, they were scared off, then
drove to Brussels where they broke
into the Variety Store. They took
cash, and cigarettes, then re-enter

money and a large number of
lottery tickets, including a binder
full of winning tickets, the attorney
said.

in, that police made the arrest. A
search warrant was obtained and
some of the property found.
Duty counsel John Schenk, told
Judge Hunter that the pair had
been recently laid off and were
drinking excessively at the time of
the incident. Both young men lived
at home and the money, he said,
had been used to buy Christmas
presents. “Mr. Smith has made
reminded him this was a first
offence for both young men and
circumstances had led to the be
haviour. “I believe they regret
their actions,” he told the court.
In addition to 12 months proba
tion, Mr. Cronin was ordered to
make restitution in the amount of
$800 to Variety store owner, Ron
Clarkson, within 24 hours. Mr.
Smith had already paid his $800
share of the money. Both must
complete 75 hours of community
service work as well.
