prepares new tree
cutting bylaw
If Grey County council has its
way, permission for a property owner
to cut timber would only be given if a
forester or other qualified person
marked the trees to be cut.
Al Bye, reeve of Derby Township
and chair of the county's General
Government, Property and Finance
Committee, said as part of the
revisions to its tree cutting bylaw the
county has been working with the
Ministry of Natural Resources and its
lawyers to try to get the provincial
changes necessary to close loopholes
in current legislation.
Too often, Bye says, a landowner
or logger could claim a tree was
diseased or damaged and needed to
be cut even if it didn't meet the
minimum cutting requirement.
Unscrupulous loggers would then cut
all trees of any size.
"After the tree's cut it's difficult
to say it shouldn't have been," Bye
said.
The committee is trying to find a
way to guarantee there is some
minimum density of trees left when
the cutting is finished.
Still, Bye says, there's a fine
balance to be maintained since it's
private land involved.
"We don't want to impose on
people's freedom and property
rights."
With no provincial legislation in
place the county has tried to promote
good woodlot stewardship by
requiring a landowner who is seeking
an intent to cut application to agree
to use a professional forester to mark
the bush. Most landowners live up to
that intention and have gained
because of the professional advice
but without a change in the law
there's no way this promise to seek
help can be enforced, Bye said.
Grey first adopted a tree cutting
bylaw seven or eight years ago. The
committee has been working on the
current revisions for almost a year.
"We've gone as far as we can go
without help from the MNR."0
