4. the right of expropriation.
Absolutely no mention is made of
reserving the right to licence our land
to the purpose of hunting or fishing or
of reserving the wildlife onto the
Crown.
I would like to make reference to a
legal opinion that was published in a
rural magazine a few years ago.
"Hunting on private land is not a
right. It is a privilege. That has been
recognized for hundreds of years.
That is why, throughout the British
Commonwealth, including Ontario,
ownership of game is vested in the
person on whose land it is situated —
not in the hunter."
My answer to solving this problem
would be as follows: hunting licences
would not be valid on private lands
unless they were accompanied with
the written permission of the land-
owner. The landowner would not be
required to give prior notice. If this
were the case, the Province would
no longer be acting illegally. A
somewhat diluted example of this
is already existence m Manitoulin
Island.
I would dearly love to see what a
property rights expert would have to
say on these matters.
