It is, and has been, an expensive learning experience and I would like readers to be able to avoid the mistakes we have made. This applies particularly to anyone in the Walkerton area who is considering appealing their assessment for environmental reasons. The Assessment Review Board operates much like any other court. There is the hearing officer(s) and a lady who does I don't know what. Both parties to the hearing are sworn, as are any witnesses. We have been to a total of six ARB hearings since 1991, successful to some degree in all of them, and it • had always been my assumption that the lady was recording the proceedings for a transcript at a possible appeal. This is not the case. There is NO recording of proceedings by the Board. In our case, the Municipal Assessment Corporation, now a crown corporation is appealing our Decision. When we presented our case we produced written, pictorial and video evidence and there was also cross- examination which illuminated some extremely important points. At the end of the proceedings I offered the two members of the Board the video which had just been shown. For reasons unknown to me, they did not make the video an exhibit. We now have to fight our case before Division Court without a transcript and possibly without the
