the smell from the barns affected the
family's quality of life on average 18
days a month. The smell was
compared to rotting flesh.
The pork producer claimed the
barns had been built to meet
municipal building bylaws but the
barns were only 514 and 577 feet
from the neighbouring houses.
Testimony showed that the pork
producer had applied for certificates
of compliance to build 1,000 -head
barns but these were turned down
because the barns did not meet
minimum distance separation
guidelines. Under MDS a 1,000 head
barn should have been 1,200 feet
from the nearest residence. The
municipality's bylaw did not require
compliance with MDS standards.
One of the barns was also classed as
an expansion of a 100 -head heifer
barn on the property, rather than a
new facility. (Eventually 2,000 -head
barns had been built.)
The board found the township had
erred in not including compliance
with MDS regulations as part of its
approval of building permits. The
tov'nship also erred in not requiring a
certificate of compliance for each of
the barns.
However, "The ultimate
responsibility for the location of the
barns rests with the agricultural
operator," the report stated. "It is our
view that (the operator) failed to take
reasonable and responsible measures
to insure the barns are situated so as
not to cause conflict with neighbours
when the barns and the tank became
operational."
The board also found that indoor
storage in manure pits and gutters
must be included in the total storage
capacity when calculating distances.
The pork farmer had expert
support from Don Hilborn, by-
product management specialist with
OMAFRA, Sam Bradshaw, envir-
onmental communications specialist
with Ontario Pork and Wayne
Caldwell, a professor with the
School of Rural Planning and
Development, University of Guelph,
all of whom testified the barns were
kept clean and well managed. The
board found that the swine -
husbandry practices were consistent
with normal farm practice.0
