property, the manner of division of such property or the
family farming business, and support obligations prior to or
during marriage while still together. This can be done in a
marriage contract. Such contract cannot decide the issues of
custody of and access to children or exclusive possession of
the matrimonial home upon separation however. It is
suggested that a marriage contract may be appropriate in
subsequent marriages to ensure that families from prior
marriages are taken care of by keeping assets separated. It
may also be useful in a marriage where one spouse has
substantially more assets than the other and fears an equal
division after a shortlived marriage.
