The Rural Voice, 1982-04, Page 34GUEST COLUMN, Cont. from pg. 24 property, the manner of division of such property or the family farming business, and support obligations prior to or during marriage while still together. This can be done in a marriage contract. Such contract cannot decide the issues of custody of and access to children or exclusive possession of the matrimonial home upon separation however. It is suggested that a marriage contract may be appropriate in subsequent marriages to ensure that families from prior marriages are taken care of by keeping assets separated. It may also be useful in a marriage where one spouse has substantially more assets than the other and fears an equal division after a shortlived marriage. Gay Stewart is a Stratford lawyer.
