TO: COUNTY OF LAMBTON
LANDOWNERS
The Lambton County Council in Session
January 9th, 1980 has enacted that-
all permits to remove woodlots, issued by
County Woodlot By-law Enforement Of-
ficers, prior to November 7th, 1979, be
declared null and void, as of January 31st,
1980.
Here after any landowners wishing to
remove a Woodlot, must apply to the Coun-
ty Woodlot Review Committee, who will
hear their submission and make a decision
thereon, subject to the approval of Lamb-
ton County Council. This is as required by
Sedan 7 (.b) of the Trees Act R.S.O. 1970 as
amended March 27, 1979 and By-Law 44,
1979 of the County of Lambton.
Applications for removal of woodlots may
be obtained from the Secretary of the
Woodlot Review Committee, Mr. James
Clarke, 700 N. Christina St., Sarnia, as
well as copies of By-Law No. 44 of 1979
referred to above.

As I indicated in a previous
artiele the government has,
brought forward legislation
to replace the current Petty
Trespass Act, an Act which
is almost identical to the
original which was passed in
1834.Legislative changes are
long overdue and two Bills,
The Trespass Property Act
and the Occupiers Liability
Actwillbring about the/ much
needed changes, k
Clearly the new legislation
will be particularly helpful
for farmers concerned about
crop thieves and school
administrations faced with
extensive vandalism. It will
mean that landowners
allowing their fields to be
used for cross country
skiing, nature walks etc. will
no longer have to fear being
sued if someone gets injured.
Possibly, as a result, more
private land will be available
for 'recreational purposes,
As leisure time and
mobility has increased so the
public has demanded more
access for recreational
pursuits. Farm equipment
and farm activities may pose
increasing hazards for in-
Ouders who may be unaware
of the risks they run. The
proposed new law expands
the classes of land which do
not 'need signs in order to
keep intruders out. This will
include land under
cultivation, gardens, or-
chards, vineyards and
premises on which trees
have been planted.
It is proposed that the
existing trespassing
prohibition should be
replaced with three specific
offences: entry without
permission; prohibited
activity; and refusal to leave
after being told to do so. The
burden of proof to show that
permission to enter has been
given lies with the accused.
Fines of up to $1,000 are
envisaged.
In addition to "no
trespassing" signs, "130
fishing" signs etc., the
government intends to allow
colour-coded signs. A sign
with a diagonal line running
through a picture of a fish or
a horse would be permissible
replacements for "no
fishing" or "no horseback
riding."

Dashwood Industries is
blowing bubbles these days
but they're not of the bubble
gum variety.
Earlier this week, the
Centralia based manufac-
turer of windows and doors
finished the erection of a
plastic bubble which covers
a 41,000, square foot storage
area addition.
The addition will allow
DIL to give two week
delivery on certain items
during their ' peak season.
The addition doubles their
storage area for finished
products.
According to honoury
chairman of the board
Morris Klump the plastic
bubble first gained
widespread use on the DEW
line in the Canadian arctic as
protection for radar units.
DIL decided to go with the
bubble because of its ease Ort
construction, portability and
the fact that the unit is one
quarter the cost of a
traditional brick and mortar
structure. The local firm is
leasing the strutture from
FK Construction Limited of
Guelph for five years,
The structure which holds
approximatley one million
cubic feet of air is supported
by seven pounds per square
foot of air pressure provided
by two ten horsepower fans.
The building has two doors,
one of which will not open
unless the other is closed. If
the structure did have a leak
it would take between six
and eight hours for the
building to completely
collapse.
The unit which had its
cement floor laid by
McCann Construction of Mt.
Carmel brings total storage
space at DIL up to 370,000
square feet.
The only source of light for
the translucent structure is
the sun with Klump saying
indirect lighting from floor
mounted lights could be
added quite easily.
The DIL installation is one
of the few units In southern
Ontario to be used for
atorage purposes.

nocent" trespassers such-as
children. Can children be"
assumed. to have willingly
assumed all risks when
entering premises, as
provided, in Section 4 011ie
Act respecting Occupiers'
Liability?
Matters such as this will,
hopefully, be ironed .out at
the Committee stage, and
the legislation has been
referred to Committee, of
which I am a Member, for
clause by clause eon-
sideration, It is anticipated
that it will be retorneidl to the
House. for Third Reading
early in the forthcoming
session.
Among the changes which
farmers would like to see is a
widening of the definition of
occupier to include a tenant,
because the number of
tenant farmers is on the
increase, They would also
like the definition of
premises to be expanded to
include implements of
husbandry. •
Farmers have also
suggested a fine of $25 for the
first offence and $100 'or the
second, although a heavier
fine would certainly be in-
dicated where there is an
element of crimanility.
It has also been suggested
that written permission or
positive entry signing would
be the only defence against
trespass. The Ontario
Federation of Agriculture
rejects the proposal that
trespass be determined by
land. status or by the land's
current use. As 'far as colour
coding of non-status land is
concerned, farmers deem
that to be impractical.
The OFA has recom-
mended that posting not be
necessary, although this is
permissible if owners so
wish. Part of the problem as
far as the OFA is concerned
is the non-existence of a code
to specify the legal meaning„
of signs in current use.
Experience has shown that
signs are all too easy .to
remove. Farmers who have
posted their, property in the
past have frequently had the
signs torn down, and once
again have found themselves
liable if anything happens to
a trespasser.
In addition, the Federation
has proposed tha‘t legal
meaning . be given to
markings in two colours, red
and yellow, and that farmers
should not have the
responsibility of posting
their land. The posting of
,. ..should be itb'e
responsibility of' the
organizations contracting
for the trail use.
Since all land is not
cultivated, farmers are
concerned about forested
lands. They are concerned,
about their woodlots, for
example. In the summer, for
instance, there could well be
the danger of fire. Forested
land should be treated the
same way as cultivated land.
Posting may be easier in this
connection, but this should
not be a reason for making it
mandatory.
