"The challenge will' be based on the grounds that Hydro's actions deny farmers their right to an effective inquiry," says Gordon Hill, President, Ontario Federation of Agriculture. "Hydro has no control over the land that will obviously be flooded by the dani. The farniers who own the land will not sell it to Hydro. The only two actions open are to stop the dani or to expropriate the land." If Hydro choses to expropriate, The Expropriation Act calls for hearings to determine whether the expropriation is 'fair, sound and reasonably necessary.' Hill notes, "The prior commitment of a huge sum of money and the substantial construction already underway will put irresistible pressure on any inquiry officer, and frustrate the. landowners in making effective objections. "Inquiry hearings should be completed before there is any commitment to construction. Failure to follow this course denies feigners their valid rights under The Expropriation Act."
