JUDGE Toe'" REPORT.
As 1 am unable to agree with my brother
arbitrators, I will briefly give my reasons :
1. 'Me section 533 let is a difficult one to
construe, I rive my opinion with great dittti-
dence. 1 think the Legislature intended
only to give relief where a township was so
burdened with bridges required for the con-
venience of the public in addition to their
other ordinary obligations that their tax-
ation was all out of proportion with the
other M unicip•liit res.
2. The arbitrator are entitled, in my
°pluion, under sub -section " h " 1" the ar-
batrator.hall amongst other matters, Ac.")
to consider the amount expended by the
municipalities upon the building and main-
tenance
aintetance of highways.
3. Morris contends that the intention of
the act is to equalize the expenditure for
bridges over 100 feet in length. Were this
the case the Legislature could easily have
arrived at that result by enacting %hitt the
county should assume all bridges over 100
feet u length; this would equalize the ex-
penditure to • cent.
4. It will be seen by the schedule that
with the exception of Turnberry, the ex-
penditure of Morris for roads is the lowest
on the 11.1. .0090. They say that their ex •
oeasive bridge expenditure prevents them
from building roads, their total rate for
roads and bridges Is .0187 ; oompre this
with Stephen .0828, grey .0246, McKillop
.0245.
A. The average rate over the county for
bridges is .00674. :-depben is .0065, Grey
.0094, if Morris is right, Stephen and Grey
paving bridge• over 100 feet in length could
obtain relief under this act, w6 McKillop
could obtain no relief, the bridge rate for
that township being .00674. 1 can ass no
fairness in McKillop with • ran of .0946
for bridges end roads contributing to the
expenditure of Morris with • rate of .0187
for bridges Sad roads, and l cannot think
that the Legislature intended to perpetrate
such an injustice, and 1 am therefore led to

6. The average road axpsaditare over the

for his worship not to have taken the case,
but to have turned it over to one or other
he resident Justices of the Peace. But
nothing suits Ins worship so well aa to pre-
side at a police court ease, where he can
righteously censure evil doers and, in par-
ticular, disclaim against the iniquity of
using foul language and obscene speech ; and
he determined to preside, and did so.
Monday morning at 10 o'clock was the time
and the clerk's Aloe was the place set for
the trial, but at the place and time appoint-
ed the defendant failed to ..ppe•r. Instead
his worship reoeived • note front defend-
ant's solicitor which must have been of some
moment for an ad • -trnen: was had until
next morning. Tuesday morning no de-
LtNncLnt appeared and there was a further
adjocrnnient until 2:30 in the afternoon.
to the meantime, the mayor was kept busy
getting legal pointers as to We way in
which to deal with the case, which was fast
assuming • ludicrous appearance. Before
2:30 t . u. a warrant was issued and Capt.
l)ancey was arrested an.l brought before
the mayor, when evidence was taken and •
further adjournment was had until Wednes-
day morning, when tbeljudgnteut, which ball
been reserved, was given. The defendant
was then fined 815 and costa, and the case
was appealed. Up to date no one hoe been
able to tivure out which of the trio was
most troubled with insomnia since Mon-
day last - the editor, the defendant or his
worship.
As you are aware, en award was made is
the above matter, a -espy of which 1 here-
with enclose. You will observe that two
of the Arbitrators concur in charging the
County with forty per ant. of the cost of
maintaining eight of the bridges in .question
for the next ten yeah, including the present
year. The award Mao directs the County
to pay forty per ciao of the Townships
costa of the retereoos, and seventy per cent.

Toss, aa you will see, dissents entirely, wad
agree* with what has been my oonteetion
throughout. Acting upon your inatruc-
ttoos I appealed from the award, and the
appeal was argued .quite recently before his
Lordship Mr. Justice Earpiece, who has
Dot yet given judgnustt. Until he does
give judgment the County- should certainly
trot act upon or recognize is any way the
award, which, there is good reason to be-
lieve, will be ultimately est aside. Of
averse the questions promoted are almost
wholly new. We have bad no legislation
of a similar character, and the matter is,
therefore, one of eoosiderable ditSculty, and
will, possibly, not be c nridered settled by
the judgment of any one judge, and •
matter which the County Council should
consider at de present suasion is whether,
supposing Mr. Justice Ferguson differs
from his Honor Judge Tons, the County
would be inclined to go any further by way
of appeal It is neotesary to topsider that
at the present session, because appeals have
to be take) within fixed periods after lodg•
mutts ase delivered front which It is intend-
ed to appeal 7'he natter could, of course,
be left in my hands, or (which I would very
much prefer, left with you and your com-
mittee instead of the Council taking any di-
rect action. The Judge before whom it was
argued I Mr. Justice Ferguson) is • very
painstaking and careful judge, and I look
forward to his judgment with greet interest,
aa I have no doubt it will ge a lung way
towards elucidetinv what- everyone admits
is • very difficult and obscure section of the
municipal law to deal with. I should also
say that during the session of the House
just closed, an AM was introduced to repeal
the Sections in question by the Member for
South Huron, but was withdrawn because
it was introdnoed too late in the session to
receive careful consideration. There is no
doubt, I think, that a more deliberate at-
tack upon the Section in question will be
made at tie next session. I mention this
for your guidance in dealing with the de-
mands which 1 understand are being made
by other Townships to be put upon the
same footing as Morris.

CHAN.:E IN K. R. Time TAtLx-There
has been a change made in the R. R. time
table at this station which, although not
great, will have • tendency to cause
trouble to travellers, if not noticed. The
morning train now goes out at 7 o'clock
