An appeal has been filed with
the Ontario Municipal Board
against a Huron County judge's
decision March 24 that rural air
pollution had reduced the
market value of a Kippen area
farm home.
The case involves a decision
of Judge R. S. Hetherington,
whose precedent-setting ruling
cut about $30 from the 1970
tax bill of Mr. and Mrs. Edison
McLean, The McLeans had
appealed their 1969 assessment
on the claim that neighbor Grant
McGregor was operating a liquid
manure storage lagoon on his
farm that was polluting the air.
The appeal was filed in
Toronto by E. F. Hall, the
Huron County assessment
commissioner in 1969 who is
now employed with the
Huron-Bruce regional assessment
department. It was sanctioned
by his superior William Vidler,
the region's assessment
commissioner.
Mr. Vidler said it may be
some weeks before the OMB sets
a hearing date and gives notice
to interested parties.
Among those parties are the
Huron Federation of
Agriculture, which called for an
immediate appeal at a meeting
April 6 in Clinton. The
federation feels that Judge
Hetherington's decision could
affect every livestock enterprise
even if it is operating within
guidelines set out in a proposed
Code of Practice for livestock
operations.
If farmers are operating
within the code, they can receive
a Certificate of Approval from
the air management branch of
the department of energy and
resources management.
The McGregors have
complied and have obtained a
certificate.
Their liquid manure storage is
located about 1,300 feet from
the McLean residence. The code
calls for a minimum of 1,000
feet.
Following the judge's
decision last month, the
responsibility for launching an
appeal was unclear for several
days.
Finally, the federation left it
in the hands of Mr. Vidler's
Farmers in Ontario will soon
be able to benefit from a new
service, announced recently by
the Minister of Agriculture and
Food, Hon, Wm. A. Stewart.
Speaking in the Legislature,
Mr. Stewart announced that the
Department would shortly

Branch an Agricultural

Feeder sale
coming up
The Annual Spring Feeder
Cattle Sale will be held on
Thursday, May 14, at 12 o'clock
noon, at the South River
Stockyards. Members of the
Parry Sound District Livestock
Co-operative developed this sale
to enlarge their marketing
service. Past sales have averaged
about 500 head. In former years,
says Mr. Sid MacDonald,
Secretary of the Co-operative,
the sale has provided a variety of
purchases to suit the needs of a
large number of people.
The percentages of the types
and ages of the cattle on sale will
soon be available, said Mr.
MacDonald. He added that the
biggest run is generally on
yearlings. This year the offering
will be about 50% yearling
steers. There should also be an
attractive number of calves.
Breeders have been using Ai
beef bulls over the last few years
and for two years a large number
of Qualified Performance Tested
Bulls have been purchased
through the Ontario Beef Bull
Sale and similar sales. Much of
the stock being offered at the
South River Stockyards will thus
have come from performance
tested bulls.
To encourage the production
of quality feeders, a Feeder
Competition is being held, to
run concurrently with the Sale.
Farmers may consign a pen of
six feeder steers or heifers,
which will be scored and sold as
a package.
office and notice of appeal was
filed on the final day allowed
after the original hearing.
There are several other liquid
storage lagoons similar to the
McGregors within an eight-mile
radius of Kippen.
relating to agricultural markets
and marketing," said Mr.
Stewart, "This information will
be assembled, summarized, and
prepared by our Information
Branch staff and made available
to the media for dissemination
to the public. We plan
appropriate groupings of
commodities, starting with those
most readily available, and
expanding the service as our
experience and facilities permit.
We believe this information
should be provided to the public
through a public agency that has
no special interest or interests,
excepting to provide reliable
information."
The Marketing Information
Service will be established at the
head office of the Department
of Agriculture and Food at 1200
Bay Street, Toronto. A
Marketing Information Officer
will be appointed, and when the
necessary equipment has been
assembled, the information will
be made available to radio
stations and other media over
conventional telephone lines.
Discussions will be held as
soon as possible to determine
the best way to serve the needs
of the industry in this area, and
to develop channels through
which this information may be
obtained and disseminated.
