Westover testified that Deg- ley entered the repair area of the garage where he engaged Ron Caldwell, owner of the staa Lion, in conversation and. then. they proceeded to Degley's car. From the office, Westover could see Dagley produce a box from. the area of the surivisor from wilier') he took a second smaller brown box. A celluloid picture strip was taken from the brown hox. Dagley then got, out of the ear and opened the think which contained two large boxes. At this point Westover phoned. Gibbons and Reid who arrived within minutes, They asked if they might search the Dagley ear and after receiving permis- sion from the owner opened the trunk and found that the boxes in the trunk contained a number of prophylactics, In the meantime 'Westover noticed from the office that .Dagley had reached into his car and removed the box con- taining the celluloid strips un- known to Gibbons and Reid who had their heads in the trunk. .Dagley then walked rather redekly to the rear of the sta- tion. Gibbons noticed. that Dag- ley had disappeared and fol- lowed him to the rear of the Station. Westover then went out the back door of the station to find that Gibbons and Dagley were standing there. Westover began to search for the brown box and. then Caldwell appeared and. pointed to a large barrel con- taining water in which was floating the brown box. Examining the box the offi. cora found that it, contained four celluloid packets contain- ing pictures of nude persons in various acts of sexual perver- sion. Later that night Constable Reid and Caldwell found two more strips containing the same type of picture in the bottom of the barrel. C.aldwell stated that Dagley had asked. him if he wanted to see some pictures and when. they got to the ear Dagley asked. the price to $21 and $18, ending the prie to $24 and $18, ending by offering them for a tank of gas. Caldwell, however, re- fused to take• them at any price. Dagley in his defence stated that he had had a heart; attack Five years ago and was hos- pitalized fot.• six and one half weeks. Since then he also stated that he had had two more at- tacks and had. spent some time in the hospital and was still un- der a dodoes care. He also claimed that he had been wrongly accused of a sim- ilar offence in Sarnia in 1960 At which time he had been fined. $750, Asked to identify the pictures by the magistrate, he started, "Yes, disgusting". Commenting on the Sarnia fine, the magistrate said :that "it was meant to hurt, to see that the individual would not. do the, same thing, Why is he back two years later?" Four character witnesses tes- tified that the accused had a fine home life and provided quite well for his family. They eeemed to he in agreement. that well an act was out of Mrs. D.
