An Act to amend t he Work.
men's Compensation Act
received• third reading and
Royal Assent on June 28, 1974,
the teat day of the Session,
The Minister of Labour, the
Honourable John MacBeth in-
troduced the. Workmen's Com,
pensation Amendment Act on
Jiine 21, 1974. Many of the
changes proposed in the Act
were based on the recommen-
dations of the Task Force on
Workmen's Compensation
which reported to the
Legislature last fall.
The new legislation effective
July 1, 1974, increased Work-
men's Compensation pensions
by a niaximum of 60% based
on the following formula: Pen-
sions, of those who became
eligible for disability pensions
during 1973 will be increased
by 4%; For those who became
eligible for pensions in 1972,
their pensions will be adjusted
by 8%; For those who became
eligible for, pensions in 1971,
their pensions will be.raised by
10% and for each further year
a• person. has been eligible for a
`disability pension prior to
,January 1, 1971, that pension
will, be increased by an ad-
ditional 2% per year to a
maximum 60% increase.
T,he legislation also-
1 Increased the earnings
ceiling for the calculation of
benefits from $10,000 to
$12,000.
2 Increased the mineurn
total permanent disability pen-
sion and widow's allowance
from $250 to $260.
' 3 Provided for the con-
tinuation oftull benefits to par-
tially disabled workmen who
are unable to find suitable em-
ployment as long as that work-
man is seeking employment or
accepting whatever training
which the Board deems ad-
visable.
4 Eliminated the
requirement that a dependant's
pension not exceed the
deceased's earnings.
5 Ensured that the pension

6 Increased the clothing
allowance for the repair or
replacement of clothing worn
or damaged by reason of
wearing an artificial limb.
This Act was passed only af-
ter a long and tiring 10 hours of
debate in the Legislature. All
Liberal members who spoke ex-
pressed disappointment with
the inadequate provisions of
the Bill.
The increase in pensions
which the Government granted
were minimal. The Liberal
Caucus feel that Workmen's
Compensation, pension's must
be directly indexed to the cost
of living - anything else is unac-
ceptable. The Government. of
Canada has taken this step in
the provision of old age security
and the income supplement
and Canada Pension Plan
payments.
Since 1965 the cost of living
has increased 55% while the
Workmen's Compensation
Amendment Act will only give
an injured worker who went on
pension in 1965, a 22% in-
crease to cover rising costs,
The Act also should have
provided for a continuation of
